EDUCATION AMENDMENT REGULATIONS (NO. 3) 1993

Made by the Minister for Education.

Citation

1.     These regulations may be cited as the Education Amendment Regulations

Schedule 2 repealed and a Schedule substituted

2. Schedule 2 to the Education Act Regulations 1960* is repealed and the

following Schedule is substituted —

FEES — TECHNICAL AND FURTHER EDUCATION

Community adult education — tuition fees for class instruction

1. Subject to clauses 2 and 3, the tuition fee for class instruction in a course classified as a community adult education course is the amount calculated on the basis of $4.15 for each hour, or part of each hour, of instruction in the course.

Concession fees for class instruction in community adult education courses

2. Subject to clause 3, the tuition fee for class instruction in a course classified as a community adult education course for —

(a) a person who holds —
(i) a Health Benefit Card;
(ii) a Health Care Card;
(iii) a Pensioner Health Benefits Card/Travel Card;
(iv) a Veterans Health Benefits Card, issued by the Department of Social Security or the Department of Veterans' Affairs of the Commonwealth; or
(v) a Rates Concession Card, issued by the Department for Community Development in this State,

and a dependant of such a person; and

(b) a person who holds a Seniors Card, issued by the Office

of Senior's Interests in this State,

is the amount calculated on the basis of $1.55 for each hour, or part of each hour, of instruction in the course but the fee payable by the
person is not to exceed $24.40 for each community adult education
course to which the person is admitted.

Tuition fees for class instruction in community adult eduction courses that have commenced

3. Where a person is admitted to a course classified as a community education course after the course has commenced, the tuition fee for the course is the amount calculated by multiplying the number of hours of instruction remaining in the course by the amount prescribed in clause 1 or 2 as the case may be.

Community adult education — tuition fees for correspondence instruction

4. The tuition fee for correspondence instruction in a course classified as a community adult education course is the amount calculated, without regard to when the person is admitted to the course, on the basis of twice the hourly rate prescribed in clause 1 or 2 as the case may be, for each lesson.

Vocational courses — administration fees

5. (1) Subject to clause 6, the administration fee for admission to a vocational course in which class instruction is given is the amount calculated on the basis of 70 cents for each hour, or part of each hour, of instruction in the course but the fee payable by a person is not to exceed $238 for each semester in which the person is admitted to a vocational course or courses.

The administration fee for a vocational course in which instruction is given by a method other than traditional class instruction (namely, the open learning program or correspondence instruction) is the same as the fee calculated under subclause (1) for class instruction in the course.

(3) In this regulation and in regulation 6 "vocational course"

means a course that is not classified as a course for community adult education, small business management, equity and access, customised training, contracted higher education, traineeship or tertiary entrance examinations.

Exemptions from administration fees for

vocational courses

6. A person —
(a) who holds

(i)      a Health Benefit Card;

(ii)     a Health Care Card;

(iii)     a Pensioner Health Benefits Card/Travel Card;

(iv)     a Veterans Health Benefits Card, issued by the Department of Social Security or the Department of Veterans' Affairs of the Commonwealth; or

(v)     a Rates Concession Card, issued by the Department for Community Development in this State,

and a dependant of such a person;

(b)

in receipt of a benefit under the AUSTUDY scheme or ABSTUDY scheme described in the Students Assistance Act 1973 of the Commonwealth, as amended from time to time; or

(c) who was enrolled in a secondary school during 1992 and

who was less than 20 years of age on 31 December

1992,

is exempt from paying an administration fee for a vocational course.

Small business management courses —
tuition fees

7. The tuition fee for class instruction in a course classified as a small business management course is the amount calculated on the basis of $4.15 for each hour, or part of each hour, of instruction in the course.

Fees to be rounded to whole dollars

8. Where the calculation under clause 1, 2, 3, 4, 5 or 7 of a fee results in an amount that is not in whole dollars, that amount is to be rounded to the nearest, highest whole dollar and the resulting amount is the fee payable.

clause is set out in column 2 opposite the matter.
