An Act to amend the Education Act 2004
The Legislative Assembly for the Australian Capital Territory enacts as follows:
Name of Act
This Act is the Education Amendment Act 2011.
Commencement
This Act commences on the commencement of the Education and Care Services National Law (ACT) Act 2011, section 6.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
This Act amends the Education Act 2004.
Establishing government schools etc
Sections 20 (1) and (2)substitute
(1)The Minister may establish government schools.
(2)The Minister may decide—
(a)the kinds of government schools to be established; and
(b)the educational level or levels (which may include preschool) for the schools.
NotePreschools are also subject to requirements under the Education and Care Services National Law (ACT).

Dictionary, definition of government school
substitute
government school—
(a)means a school established under section 20 (1); and
(b)except for section 20—includes a school-related institution established under section 20 (3).
Dictionary, definition of school
substitute
school—
(a)except for chapter 2, chapter 4 and part 6.2—means a government school; and
(b)for chapter 2 (Compulsory education) and part 6.2 (Other provisions)—means a government school or a non-government school; and
(c)for chapter 4 (Non-government schools)—see section 74.
