Education (Amendment) Act 1998†

The Parliament of Victoria enacts as follows:
1. Purposes
The main purposes of this Act are—
(a) instruction in connection with pageants,
to make provision relating to religious and
(b)
to repeal outdated provisions relating to assessment and education of students with disabilities or impairments.

2. Commencement
(1) This Act (except section 9(1)) comes into
operation on the day that it receives the Royal
Assent.
(2) Section 9(1) is deemed to have come into
operation on 1 July 1998.
3. Principal Act
In this Act, the Education Act 1958 is called the No. 6240.

(1) In section 23(2) of the Principal Act—
(a)
in paragraph (b), after "such schools," insert "or having regard to the preparation or conduct of a pageant, special event or celebration of a festival in a school or schools,";
(b) in paragraph (c), omit "at any class".
(2) In section 23 of the Principal Act, after sub-
section (2) insert—
"(2A) The Minister may give an authorisation
under sub-section (2) in respect of the
preparation or conduct of a particular class
of pageant, special event or celebration of a
festival generally to all schools, to a class or
classes of school or to a specific school.".
5. Repeal of Division 2 of Part IV
Division 2 of Part IV of the Principal Act is repealed.

6. Amendment of definitions consequential on repeal
(1) In section 3(1) of the Principal Act—
(a) in the definition of "school age" omit "(subject to Division 2 of Part IV of this Act)"; (b) in the definition of "special school" for with disabilities or impairments".
(2) In section 3(2) of the Principal Act omit "(subject
to Division 2 of Part IV of this Act)".
7. New section 25AA inserted
After section 25 of the Principal Act insert—
"25AA. Parent not required to contribute to cost of
additional support
A parent of a student with a disability or impairment is not required to contribute to the cost of the provision of additional support for the education in a State school of that student.".
8. Other amendments consequential on repeal
(1) In section 64N(4) of the Principal Act, for disability or impairment".

9. Statute law revision
(1) In the Principal Act—
(a)
in section 5(3), for "Chief Executive's" substitute "Secretary's";
(b)
in section 13(9), for "Director" (where twice occurring) substitute "Secretary".
(2) For section 25(10) of the Principal Act
substitute—
"(10) Section 15 and Part 5 of the Subordinate
Legislation Act 1994 apply to an Order
made under sub-section (7) as if the Order
were a statutory rule within the meaning of
that Act, notice of the making of which had
been published in the Government Gazette
on the day on which the Order was published
in accordance with section 84(3) of thisAct.".
