AN ACT to amend the Education Act, 1928-1975.

[Assented to 1st December, 1975.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Education Short title and

Act Amendment Act (No. 3), 1975. citation.

(2) In this Act the Education Act, 1928-1975 is Approved for reprint

Commence-

ment. 2.

(1) Subject to subsection (2) of this section the provisions of this Act shall come into operation on the date on which this Act receives the Royal Assent.

(2) The provisions of sections 3, 4, 5, 9, 10 and 11, paragraph (b) of section 12, and sections 14, 15 and 16 of this Act shall come into operation on a date to be fixed by proclamation.

Section 15

amended. 3. Section 15 of the principal Act is amended

(a)	as to subsection (2), by deleting the words "twenty dollars" in the last line and substituting the words "two hundred dollars"; and
(b)	as to subsection (3), by deleting the words "Twenty dollars" in the last line and substituting the words "Two hundred dollars".

Section 16

amended. 4.

Subsection (1) of section 16 of the principal Act is amended by deleting the words "pay a penalty of not less than two dollars nor exceeding ten dollars" in the last two lines and substituting the words "a penalty not exceeding two hundred dollars".

Section 17

amended. 5. Section 17 of the principal Act is amended

(a)	as to subsection (3), by deleting the words "forty dollars" in the last line and substituting the words "five hundred dollars"; and
(b)	as to subsection (5), by deleting the words "forty dollars" in the last line and substituting the words "two hundred dollars".

Section 17A

6. Subsection (1) of section 17A of the principal Act is amended by deleting the words "constantly and" in line four. amended.

7.    Subsection (1) of section 17B of the principal amender

Act is amended by deleting the passage "may, with the consent in writing of the Minister," in lines seven and eight and substituting the word "may".

8.    Subsection (1) of section 18 of the principal =dne,18.

Act is amended by deleting the words "constantly and" in line one.

9.    Section 19 of the principal Act is amended by ,,eia°dneci,

deleting the words "One dollar" in the last line and

substituting the words "Two hundred dollars".

Section 20

Subsection (6) of section 20 of the principal Act is amended by deleting the words "of not less than two dollars and not more than ten dollars" in the last two lines and substituting the words "not exceeding two hundred dollars". amended.

Section 31 of the principal Act is amended by deleting the passage commencing with the word "pay" in line twenty-five and ending with the word "month" in the last line and substituting the words "a penalty not exceeding one hundred dollars".	Section 31

12. Subsection (1) of section 32A of the principal amended.

Act is amended

(a) by deleting the words "leaving certificate examination of the Public Examinations Board of Western Australia" in lines three, four and five and substituting the words "final year of secondary education"; and

(b) by deleting the words "Twenty dollars" in the last line and substituting the words "Two hundred dollars".

Section 32B

amended. 13.

Subsection (2) of section 32B of the principal Act is amended by deleting the passage ", together with the names of the proprietors, head masters or principal teachers of the schools" in lines three and four.

Section 32C

amended. 14.

Subsection (2) of section 32C of the principal Act is amended by deleting the words commencing with the word "fifty" in line four and ending with the word "continues" in the last line and substituting the words "two hundred dollars for a first offence and to a penalty not exceeding five hundred dollars for a second or subsequent offence".

Section 34 15.

Subsection (2) of section 34 of the principal Act is amended by deleting the words "four dollars" in the last two lines and substituting the words "one hundred dollars".

Section 35 of the principal Act is amended by deleting the words "four dollars and not less than one dollar" in the last two lines and substituting the words "two hundred dollars".
