AN ACT to amend the Education Act, 1928-1974.

[Assented to 9th May, 1975.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Education Sbort title

2. (1) Subject to subsection (2) of this section the provisions of this Act shall come into operation on the date on which this Act receives the Royal Assent.

(2) The provisions of sections 3, 4, 5, 6, 8 and 9 of this Act shall be deemed to have come into operation on the 1st January, 1975.

3. Section 3 of the principal Act is amended

(a)

by adding after the interpretation

"Teacher" an interpretation as follows

"Teacher education course" means

(a)

a course of teacher education provided by a teachers' college; and

(b)

a course of study provided by any other tertiary education institution that is approved pursuant to subsection (4) of section thirty-seven A of this Act as a teacher education course for the purposes of this Act; ; and

(b)

by adding after the interpretation "Teachers' College" an interpretation as follows

"Tertiary education institution" has the same meaning as that expression has in and for the purposes of the West- ern Australian Tertiary Education Commission Act, 1970; .

Section 9D

amended.

4. Section 9D of the principal Act is amended

(a)

by deleting the word "and" after paragraph (a) of subsection (2); and

(b)

by deleting paragraph (b) of subsection (2) and substituting paragraphs as follows

in the case of a scholar who is in the fourth year of a course of secondary education, twenty-five dollars per annum; and

(c) in the case of a scholar who is in the fifth year of a course of secondary education, fifteen dollars per annum, .

5. Section 28 of the principal Act is amended by =iodnecr

substituting for the words "enrolled in teachers' colleges" in lines five and six of paragraph (a) of subsection (2), the passage "pursuing teacher education courses and receiving financial assistance pursuant to section thirty-seven A of this Act".

6. Paragraph (b) of subsection (3) of section

amended'.

37AE of the principal Act is amended by substituting for the words "attending a course of training at a teachers' college" in lines four and five, the passage "pursuing teacher education courses and receiving financial assistance pursuant to section thirty-seven A of this Act".

7. Paragraph (g) of subsection (3) of section Section 37AE

further

37AE of the principal Act is amended—

amended.

(a)

by deleting the words "under the regula- tions" in line two;

(b)

by deleting the words "as graded in accord- ance with the regulations" in lines five and six; and

c )

by substituting for the words "the regula- tions with respect of any such allowances that are payable to him" in lines four, five and six of subparagraph (iii), the words "any determination of the Minister in respect of any such allowances that are payable to that teacher".

8. Section 37AF of the principal Act is amended— ,=°d'accr.AP

(a) as to subsection (1), by substituting for the words "or any student enrolled in a teachers' college" in lines two and three, the passage ", or any student pursuing a teacher educa- tion course and receiving financial assist- ance pursuant to section thirty-seven A of this Act"; and

(b)

as to subsection (3), by substituting for the words "in a teachers' college" in subpara- graph (ii) of the definition of "service" in paragraph (b), the words "pursuing a teacher education course".

Section 37A

amended.

9. Section 37A of the principal Act is amended

(a)

by repealing subsection (1) and re-enacting that subsection as follows

(1) The Minister may give financial assistance to a student pursuing, or seek- ing to be admitted to,

(a)

a course of teacher education provided by a teachers' college;

or

(b)

a course of study provided by any other tertiary education institution that is approved pursuant to subsection (4) of this section as a teacher education course for the purposes of this Act,

either by way of a loan or by entering into an agreement for a bond conditioned on the due performance and observance by the student of the terms and conditions on his part to be performed and observed and contained in the agreement. ; and

(b)

by adding after subsection (3) a subsection as follows

(4) The Minister may, by instrument in writing, approve a course of study provided by a tertiary education institu- tion (other than a teachers' college) as a teacher education course for the purposes of this Act. .
