AN ACT to amend section 9B, section 21E, and

section 37A of the Education Act, 1928-1972.

[Assented to 30th May, 1973.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent

of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Education

This Act shall be deemed to have come into

operation on the first day of January, 1973.

3.

Section 9B of the principal Act is amended

amended.

(a)

as to subsection (1), by substituting for the passage "subsection (2) of this section", in line seven, the words "regula- tions made by him under this Act"; and

(b)

as to subsection (2) by substituting for the passage commencing with the word "For", and ending with the word "to", being the first nine lines of that subsection, the passage "The moneys representing the amounts specified under subsection (1) of this section shall be paid, in every year, to those".

(c)

by inserting after subsection (2) a new subsection as follows

(2a) For the year commencing the first day of January, 1973, and for each of the next succeeding four years the amount specified under subsection (1) of this section shall not be less than, in the case of a scholar who is in any year of a course of primary education, thirty dollars per annum; and in the case of a scholar who is in any year of a course of secondary education, forty dollars per annum.

(2) The amount, the time and method of payment and repayment, and the terms and conditions applicable to the financial assist- ance given shall be as prescribed.

Where an agreement in a form pre- scribed is entered into under the provisions of this section between the Minister and a stu- dent either alone or with others, that agreement shall

if a parent or guardian of the student, or if he has no parent or guardian a stipendiary magistrate, endorses his consent to the execution by the student of the agreement; and

(b)

if the student accepts any financial assistance under the agreement,

be binding upon the student and all other parties to the agreement as to each and every term and condition expressed therein to be binding upon him or them notwithstanding that at the time when he executed the agree- ment the student was under the age of majority.
