AN ACT to amend the Education Act, 1928-1960.
[Assented to 16th November, 1961.]
RE it enacted by the Queen's Most Excellent
Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:--
1. (1) This Act may be cited as the Education and
Amendment Act, 1961.

| amended. | 2. (1) Subsection (3) of section thirty-seven AF |
of the principal Act is amended
| (a) | by substituting for the passage, "on the ground of seniority to the teacher who is promoted and such other grounds as are prescribed" in lines five, six and seven of paragraph (a), a passage as follows |
on the ground of-
(i) superior efficiency to that of the teacher promoted; or
(ii) equal efficiency and seniority to the teacher promoted. ;
| (b) | by substituting for the passage, "For the purposes of this subsection "seniority" means" in lines one and two of paragraph (b) a passage as follows |
For the purposes of this subsection-
(i) "seniority" means ;
(c) by adding after the word, "college" in line six of paragraph (b), the words, "and as a science teacher exhibitioner at the University of Western Australia"; and
| (d) | by adding after the word, "continuous", being the last word in paragraph (b), a passage as follows- |
; and
(ii) "efficiency" has the same meaning as it has in Part XIV of the regulations .
(2) This section shall be deemed to have come into operation on the same day as that proclaimed for the coming into operation of the Education Act Amendment Act, 1960, namely, the seventeenth day of April, one thousand nine hundred and sixty-one.
