ATST ORDINANCE

To amend the Education Ordinance 1937-1942.

BE it ordained by the Governor-General in and over the Com-Executive Council, in pursuance of the powers conferred by the monwealth of Australia, with the advice of the Federal Seat of Government Acceptance Act 1909-1938 and the Seat of
Government (Administration) Act 1910-1940, as follows:—

1.— (1.) This Ordinance may be cited as the Eclucation short title

Ordinance 1947.* and citation-

(2.) The Education Ordinance 1937-1942 is in this Ordinance

referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,

may be cited as the Education Ordinance 1937-1947.

2. After section nine of the Principal Ordinance the following

section is inserted :—

" 9 A . — (1.) Any person who by paid employment or otherwise Employment

employs, or permits to be employed, a child under the school leav- under school
ing age during any time during which the parent or guardian of leavmg age-

the child—

(a) is required by this Ordinance to cause the child to

attend a school;

(b) would be required by this Ordinance to cause the child to attend a school if the parent or guardian or the child were resident in the Territory; or

(c) would, but for the provisions of sections ten and eleven of this Ordinance, be required by this Ordinance to cause the child to attend a school,

shall be guilty of an offence.

Penalty: For the first offence, Five pounds, and for any

subsequent offence, Twenty pounds.

"' (2.) It shall be a good defence in any prosecution under this

section that, at the date alleged in the information—

(a) the person charged had reasonable grounds for believ- ing that the child so employed was not of school going age; or

(b) the prescribed person or authority had granted an exemption certificate under this Ordinance in respect of the child so employed, and the certificate was in force.".

Certain

a\erments to he 3. Section twelve of the Principal Ordinance is amended—
prima facie
evidence. (a) by omitting from sub-section (1.) the words " or section n ine" and inserting in their stead the words ", section nine or section 9A " ;
(b) by omitting from that sub-section the symbols and letter "(b) ", second occurring, and inserting in their stead the symbols and letter " (c) " ; and
(c) by inserting at the end of that sub-section the following

paragraph:—

" or, (d) That the child named in the information

was employed at the time of the alleged offence.".
