EastLink Project Amendment Regulations 2025

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the EastLink Project Regulations 2016—

(a)as a consequence of the enactment of the Firefighters' Presumptive Rights Compensation and Fire Services Legislation Amendment (Reform) Act 2019, the Transport Legislation Amendment Act 2019 and the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019; and

(b)to make other minor and technical amendments.

2Authorising provision

These Regulations are made under section 258 of the EastLink Project Act 2004.

3Principal Regulations

In these Regulations, the EastLink Project Regulations 2016[1] are called the Principal Regulations.

4Objectives

In regulation 1(j) of the Principal Regulations, for "administrative costs" substitute "the amount".

5Definitions

In regulation 4 of the Principal Regulations—

(a)in the definition of digital file, in paragraphs (b) and (c)—

(i)after "vehicle" insert "or trailer";

(ii)after "driven" insert "or towed";

(b)in the definition of digital image—

(i)after paragraph (a) insert—

"(ab)an image of a trailer or of part of a trailer attached to a vehicle that has been taken and processed into a digital format by a digital toll camera unit; or";

(ii)in paragraph (b), after "(a)" insert "or (ab)";

(c)in the definition of testing officer, in paragraph (b), for "Secretary to the Department of Economic Development, Jobs, Transport and Resources" substitute "Transport Secretary";

(d)in the definition of toll message file, in paragraphs (a) and (b)—

(i)after "vehicle" insert "or trailer";

(ii)after "driven" insert "or towed".

6Vehicles exempt from payment of tolls

(1)For regulation 5(b)(i) of the Principal Regulations substitute—

"(i)Fire Rescue Victoria; or".

(2)For regulation 5(b)(ii) of the Principal Regulations substitute—

"(ii)the Department of Energy, Environment and Climate Action; or".

(3)In regulation 5(j) of the Principal Regulations, for "2009" substitute "2017".

(4)The note at the foot of regulation 5(j) of the Principal Regulations is revoked.

(5)At the foot of regulation 5 of the Principal Regulations insert—

"Notes

7Prescribed process for production of printed image

(1)In regulation 14(1)(c)(i) and (ii) of the Principal Regulations—

(a)after "vehicle" insert "or trailer";

(b)after "driven" insert "or towed".

(2)In regulation 14(2)(b)(i) and (ii) of the Principal Regulations—

(a)after "vehicle" insert "or trailer";

(b)after "driven" insert "or towed".

8Regulation 15 amended

(1)In the heading to regulation 15 of the Principal Regulations, after "vehicle" insert "or trailer".

(2)In regulation 15(1) of the Principal Regulations—

(a)in paragraph (a), for "Secretary to the Department of Transport" substitute "Transport Secretary";

(b)in paragraph (b)—

(i)for "Secretary to the Department of Transport" substitute "Transport Secretary";

(ii)after "vehicle" insert "or trailer".

(3)In regulation 15(2) of the Principal Regulations—

(a)in paragraph (a), for "Secretary to the Department of Transport" substitute "Transport Secretary";

(b)in paragraph (b)—

(i)for "Secretary to the Department of Transport" substitute "Transport Secretary";

(ii)in subparagraph (i), after "vehicle" insert "or trailer".

9Regulation 18 amended

(1)In the heading to regulation 18 of the Principal Regulations, for "costs" substitute "amount".

(2)In regulation 18 of the Principal Regulations, for "costs are" substitute "amount is".
