The Australian Fisheries Management Authority makes the following determination in accordance with a decision made by the Commissioners under section 23 of the Fisheries Administration Act 1991.

1 Name
This instrument is the Eastern Tuna and Billfish Fishery (Total Allowable Commercial Catch) (Undercatch and Overcatch) Determination 2018.
2 Commencement
This instrument commences on the day after it is registered on the Federal Register of Legislation.
3 Revocation
This instrument is repealed on 1 January 2021.
4 Authority
This instrument is made pursuant to paragraph 17(6)(aa) of the Fisheries Management Act 1991 under the Eastern Tuna and Billfish Fishery Management Plan 2010.
5 Definitions
A term used in this instrument that is defined for the purposes of the Plan has the same meaning in this instrument as it has in the Plan.
Note: Terms defined in the Fisheries Management Act 1991 have the same meaning in this instrument.
6Total Allowable Commercial Catch
(1) This section applies to the fishing seasons:
(a) commencing on 1 January 2019 and ending on 31 December 2019; and
(b) commencing on 1 January 2020 and ending on 31 December 2020.
(2) For the purpose of subsection 3.2(1) of the Plan, total allowable commercial catch (the TACC) for each quota species is:
(a) 2,500 tonnes whole weight for Albacore tuna; and
(b) 1,056 tonnes whole weight for Bigeye tuna; and
(c) 1,250 tonnes whole weight for Broadbill swordfish; and
(d) 351 tonnes whole weight for Striped marlin; and
(e) 2,400 tonnes whole weight for Yellowfin tuna.
7 Overcatch and undercatch
(1) This section applies to the fishing seasons:
(a) commencing on 1 January 2019 and ending on 31 December 2019; and
(b) commencing on 1 January 2020 and ending on 31 December 2020.
(2) For a species of fish specified in an item in column 1 of the table, then:
(a) for the purpose of section 4.5 of the Plan, the determined percentage of overcatch is determined by column 2 of the table; and
(b) for the purpose of section 4.5 of the Plan, the determined weight of overcatch is determined by column 3 of the table; and
(c) for the purpose of subsection 4.6(3) of the Plan, the determined percentage of undercatch is determined by column 4 of the table.
