Plan under the Fisheries Act 1988

1Citation

This Plan may be cited as the East Point Aquatic Life Reserve Management Plan 1993.

2Commencement

This Plan shall take effect from 1 February 1993.

3Application

This Plan applies to the fishery management area known as East Point Aquatic Life Reserve declared by notice in Gazette No. S51 published on 8 October 1992.

4Interpretation

In this Plan, unless the contrary intention appears:

Reserve means the fishery management area to which this Plan applies.

sedentary organism means a sedentary organism within the meaning of the Continental Shelf (Living Natural Resources) Act 1968 of the Commonwealth, and includes part of a sedentary organism and a sedentary organism that is dead.

5Amateur fishing permitted
  • (1)

    A person may, subject to this Plan, engage in amateur fishing in the Reserve.

  • (2)

    A person shall not, in the Reserve, take fish for sale.

6Gear which may be used

A person shall use only rod and line and attachments, or handline and attachments, to fish for or take fish in the Reserve.

7Undersize fish not to be taken
  • (1)

    A person shall not, in the Reserve, take a fish that is less than 30 cm long.

  • (2)

    A fish (other than a sedentary organism) shall be deemed not to have been taken if, as soon as possible after it has been taken, it is returned, with as little damage to the fish as possible, to the water from which it was taken.

  • (3)

    A person shall not, in the Reserve:

    • (a)

      take a sedentary organism; or

    • (b)

      injure or destroy a sedentary organism, other than a sedentary organism brought into the Reserve by the person.
