EAST PERTH CEMETERIES

REPEAL ACT 1994

No. 61 of 1994

AN ACT to repeal the East Perth Cemeteries Act 1932 and to vest the East Perth Cemetery in the National Trust of Australia (WA.).

[Assented to 7 November 1994.]

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the East Perth Cemeteries Repeal

Act 1994.

Commencement

2.    This Act comes into operation on the day on which it

receives the Royal Assent.

Repeal

3. The East Perth Cemeteries Act 1932 is repealed.

East Perth Cemetery reverted

4.     (1) By this subsection, the East Perth Cemetery —

(a)	is no longer vested in the National Parks and Nature Conservation Authority under Part III of the Land Act 1933 as a "Disused Burial Ground"; and
(b)	is vested in The National Trust of Australia (W.A.) under that Part as an "Historic Site".

(2) In subsection (1) —

"East Perth Cemetery" means Reserve No. 21054,

classified as of Class A under section 31 of the Land

Act 1933 and containing 4.452 2 hectares;

"The National Trust of Australia (WS)" means the

body established by section 4 (1) of the National Trust

ofAustralia (WA.) Act 1964.
