AN ACT to amend the East Perth Cemeteries

Act, 1932.

[Assented to 3rd June, 1976.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the East Perth mart title

Cemeteries Act Amendment Act, 1976. citation.

(2) In this Act the East Perth Cemeteries Act, it°329°'

1932 is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the East Perth Cemeteries Act, 1932-1976.

Commence-

ment. 2. This Act shall come into operation on the day

that the National Parks Authority Act, 1976 comes

into operation.

Section 3

amended. 3. Section 3 of the principal Act is amended

(a)	as to subsection (1), by deleting the passage commencing with the word "shall" in line six and ending with the passage "1895," in line eight and substituting the passage "shall be deemed to be under the management and control of the National Parks Authority established under the National Parks Authority Act, 1976, (in this section referred to as "the Authority")"; and
(b)	by repealing subsection (2) and substituting the following subsection

(2) The Authority shall not be deemed to have any vested estate or interest in the land referred to in the Schedule to this Act but may exercise in relation to such of the land referred to in that Schedule as is from time to time comprised in Reserve A21054 known as East Perth Cemetery (Disused) all the rights, powers, authorities, duties and obligations of the trustees of a disused burial ground under the Cemeteries Act, 1897. .
