Queensland Eagle Farm Racecourse Amendment Act 1991 Act No. 93 of 1991 An Act to amend the Eagle Farm Racecourse Act 1955 [Assented to 11 December 1991]

2 Eagle Farm Racecourse Amendment Act 1991 No. 93, 1991 BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows. Short title 1. This Act may be cited as the Eagle Farm Racecourse Amendment Act 1991 . Amended Act 2. The Eagle Farm Racecourse Act 1955 is amended as set out in this Act. Replacement of s.3 (Meaning of terms) 3. Section 3— omit, insert — ‘Definitions ‘3. In this Act— “trust land” means the land described in the Schedule; “trustee” means a person appointed to the office of trustee under section 5. ’. Amendment of s.4 (Declaration of trusts) 4. Section 4— omit ‘ freehold lands under “ The Real Property Acts, 1861 to 1952 ,” described in the Schedule to this Act ’, insert ‘ trust land ’.

3 Eagle Farm Racecourse Amendment Act 1991 No. 93, 1991 Replacement of s.5 (Number of trustees and appointments of new trustees) 5. Section 5— omit , insert — ‘Appointment and removal of trustees ‘5.(1) Subject to subsection (2), the Governor in Council may— (a) appoint a person to the office of trustee for the purposes of this Act; and (b) remove or suspend a person appointed to the office. ‘(2) The number of trustees at any time must be either 3 or 4. ’. Amendment of s.6 (Powers of trustees) 6. Section 6(1), (2) and (3)— omit , insert — ‘(1) Subject to this section, the trustees may— (a) mortgage some or all of the trust land; or (b) lease some or all of that part of the trust land described in Part 2 of the Schedule; or (c) accept grants or gifts of money for the purpose of acquiring land; or (d) acquire land. ‘(2) The trustees must not exercise any power under subsection (1) without the prior written consent of the Minister. ‘(3) Any land acquired by the trustees under this section is— (a) vested in them on the same trust as the trust land; and (b) taken to be included in Part 2 of the Schedule. ’. Amendment of s.7 (Application of moneys) 7. Section 7—

4 Eagle Farm Racecourse Amendment Act 1991 No. 93, 1991 omit ‘ freehold lands subject to “ The Real Property Acts, 1861 to 1952 ,” described in the Schedule to this Act, or any part of those lands ’, insert ‘ trust land, or any part of the trust land ’. Insertion of new s.10 8. After section 9— insert — ‘Application of Financial Administration and Audit Act 1977 ‘10. For the purposes of the FinancialAdministrationandAuditAct1977 , the trustees are taken to be a “statutory body” within the meaning of that Act. ’. Savings 9. The persons who were trustees under the Eagle Farm Racecourse Act 1955 immediately before the date of assent are taken to have been appointed to the office of trustee under section 5 of the Act on that day.
