An Act to stay Proceedings against the Colonial Treasurers of New South Wales and Van Diemen's Land respectively or any other person for collecting levying or receiving Duties, [10th August, 1825.1"

WH E R E A S o ther person who m a y have collected or received any R a t e or D u t y

it is expedient t h a t t he Colonial Treasurers of New

South W a l e s and V a n Diemen ' s L a n d respectively and every

upon any goods wares or merchandize impor ted in to N e w Sou th Wales or V a n Diemen 's L a n d respectively should he protected from vexat ious sui ts Be it therefore enacted by H i s Excel lency the Governor of N e w Sou th W a l e s w i th t h e advice of t h e Council t h a t from and after t h e pass ing of th i s Act no personal act ion or suit ind ic tment informat ion or proceeding whatsoever shal l be commenced or prosecuted against any Treasurer Nava l Officer or o ther person whatsoever in New South W a l e s or V a n Diemen ' s L a n d respectively for hav ing collected

Diemen ' s L a n d previous to t h e pass ing of th is present L a w or Ordinance a n d t h a t if any act ion suit ind ic tment information or o ther proceeding shall hereafter be commenced or prosecuted for or by reason of any such D u t y or R a t e collected received and levied as aforesaid it shall be lawful for t h e defendant in any such proceeding as aforesaid to apply to t h e Court in Which the same shall be brought; du r ing t h e s i t t ing of such Court or to t he J u d g e thereof du r ing vacat ion a n d such Cour t or J u d g e respectively is hereby required to stay such proceedings accordingly.
