An Act to amend the Duties Act 1999

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Duties Amendment Act 2012 (No 2).

  2. Commencement

    This Act commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This Act amends the Duties Act 1999.

  4. Dutiable property
    Section 10 (1) (k)

    substitute

    (k)an interest in any dutiable property mentioned in paragraphs (a) to (j), except to the extent that—

    (i)it is, or is attributable to, an option over dutiable property; or

    (ii)it is an interest under a sublease that—

    (A)is granted for a term of 30 years or less; and

    (B)is not a long-term lease.
