Dust Diseases Tribunal Act 1989 Rule relating to extension of limitation period in respect of claims for damages for dust diseases (1990-654) [GG No 123 of 5.10.1990] (NSW)
1990 - NO. 654
DUST DISEASES TRIBUNAL ACT 1989 - RULE
(Relating to extension of limitation period in respect
of claims for damages for dust diseases)
NEW SOUTH WALES
[Published in Gazette No. 123 of 5 October 1990]
HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Dust Diseases Tribunal Act 1989, has been pleased to make the Rule set forth hereunder.
JOHN DOWD
Attorney General.
The Dust Diseases Tribunal Rules are amended by omitting from rule 3 the matter "sections 58-60" and by inserting instead the matter "Division 3 of Part 3".
EXPLANATORY NOTE
The Dust Diseases Tribunal Rules presently authorise the registrar of the Dust Diseases Tribunal to exercise the functions of the Tribunal under certain provisions of the Limitation Act 1969 in relation to the extension of the period within which claims for damages for dust diseases are required to be brought before the Tribunal.
The object of this Rule is to amend the Rules as a consequence of the Limitation (Amendment) Act 1990 (which has amended the relevant provisions so as to confer a new discretion to extend the limitation period for personal injury claims in certain specified circumstances). The Rule will enable the registrar to exercise the Tribunal's functions under the amended provisions.
