An Act to enable the present Collector of
Customs (William Augustine Duncan

Esquire) to retire upon a Superannuation

Allowance. [ 1 3 ^ April, 1880.]

V V to be Collector of Customs a t More ton Bay in t h e year one
thousand e ight h u n d r e d and forty-six A n d whereas a t a la ter period
he was promoted to be Collector of Cus toms a t Sydney A n d whereas

the said W i l l i a m A u g u s t i n e D u n c a n Esqu i re was removed from his office in t he year one thousand e ight h u n d r e d and s ix ty-e ight and in a short t ime af terwards was re ins ta ted i n t h e said office so causing a break in his cont inuous service by which doubts were th rown upon his r i g h t to re t i re upon t h e Superannua t ion Allowance to which he

would otherwise h a v e been ent i t led A n d whereas i t is expedient to
remove a n y such doubts a n d val idate t he r i gh t of t he said Wi l l i am
A u g u s t i n e D u n c a n to re t i re upon a Superannua t ion Al lowance as

here inaf ter provided Be i t therefore enacted by t h e Queen ' s Most Exce l l en t Majesty b y and wi th t h e advice and consent of the Legislat ive Council and Legis la t ive Assembly of N e w South W a l e s in Pa r l i amen t assembled a n d by t h e au thor i ty of t he same as follows :—

1. U p o n the appl icat ion of the said W i l l i a m A u g u s t i n e D u n c a n

to ret i re from t h e Pub l ic Service unde r t he provisions of th is A c t i t shall be lawful for t h e Governor w i th t he advice of t h e Execu t ive Council to g ran t to t he said W i l l i a m Augus t ine D u n c a n such Superannua t ion Al lowance as he would be legally ent i t led to b u t for such break in his

cont inuous service.
2. Al l sums so made payable to t he said W i l l i a m Augus t ine

D u n c a n shal l be paid out of t he Consolidated Revenue E u n d under Avarrant or order of t h e Governor directed to t he Colonial Treasurer who in his accounts shall be allowed credit for all sums of money paid in p u r s u a n c e of such w a r r a n t or order A n d t h e receipts of t h e said W i l l i a m Augus t ine D u n c a n or person author ized as aforc'said shall be full and valid discharges to t h e said Treasurer in respect of all pay­

men t s m a d e unde r t he au thor i ty of th i s Ac t .
