Clause 1 Dumaresq Local Environmental Plan No 22

Dumaresq Local Environmental Plan No 22

1     Name of plan

This plan is Dumaresq Local Environmental Plan No 22.

2     Aims of plan

(1) This plan aims:

(a)	to allow, with the consent of Armidale Dumaresq Council, the carrying out of development for the purpose of landfill on land within Zone No 1 (a) (the General Rural Zone) under Dumaresq Local Environmental Plan No 1 (the Principal Plan), and
(b)	to insert in the Principal Plan a definition of landfill.

(2) This plan also updates the definition of council in the Principal Plan as a consequence of the amalgamation of Armidale City Council and Dumaresq Shire Council as Armidale Dumaresq Council.

3     Land to which plan applies

This plan applies to all land in the local government area of Armidale

Dumaresq under Dumaresq Local Environmental Plan No 1.

4 Amendment of Dumaresq Local Environmental Plan No 1

Dumaresq Local Environmental Plan No 1 is amended as set out in

Schedule 1.

(Clause 4)

[1]     Clause 6 Interpretation

Omit “Council of the Shire of Dumaresq” from the definition of council in

clause 6 (1).

Insert instead “Armidale Dumaresq Council”.

[2]     Clause 6 (1), definition of “landfill”

Insert in alphabetical order:

landfill means land used for the purpose of disposing of waste

to fill the land.

[3]     Clause 9 Zone objectives and development control table

Insert after Item 1 (b) in the matter relating to Zone No 1 (a) in the Table to the clause:

(c) to allow development for the purpose of landfill in locations considered appropriate by the council.

Insert “landfill;” in alphabetical order in Item 4 (Prohibited) of the matter relating to Zones Nos 1 (b), 1 (c), 2 (v), 4 (a), 7 (a) and 10 (a).
