Act No. 18, 1913.

An Act to sanction the construction of a line of Railway from Dubbo to Werris (^reek ; to provide for the use of the said line by the Con- structing Authority, or by persons authorised by h im; to amend the Public Works Act, 1912 ; and for purposes consequent thereon and incidental thereto. [15th October, 1913.]

Assembly did, by resolution, declare that it was expedient WH E R E A S the Puhlic Works Act, 1912, the Legislative
to carrv out a certain work, narnelv, the construction of a line of railway from Dubbo to Werris Creek: And whereas,

in accordance with the provisions of

by a n d wi th t h e advice and consent of t he Legis la t ive
Counci l and Legis la t ive Assembly of N e w Sou th Wales
in P a r l i a m e n t assembled, and by the author i ty of the

same, as follows :—

1 . This A c t may be ci ted as t he " D u b b o to Wer r i s
Creek Ra i lway Act , 1 9 1 3 . "
2 . The ca r ry ing ou t of t h e said work, more par t icu­

lar ly described in t h e Schedule to th is Act , is hereby sanctioned, and the Secretary for Publ ic W o r k s , or t he

m e m b e r of t he Execu t ive Council for t h e t i m e be ing

pe r fo rming t h e dut ies of t he said Secretary, is hereby author ised to unde r t ake and carry out t h e said work, subject to t h e provisions of th is Act , a n d for t h a t purpose shal l be and shal l have the powers of a Con­ s t ruc t ing A u t h o r i t y wi th in t h e m e a n i n g of t h e Pub l i c

and shal l not , unde r any c i rcumstances , exceed t h e
es t imated cost by more t h a n t en per c e n t u m .

5 . The said l ine of rai lway may be cons t ruc ted on or a long or by t h e side of any publ ic road or h ighway .

6 . N o t w i t h s t a n d i n g the provisions of section n ine ty-
one of t h e Pub l ic W o r k s Act , 1912, the Cons t ruc t ing
A u t h o r i t y shall not be compelled, nor shall i t be t h e

du ty of t he said A u t h o r i t y to m a k e or ma in t a in a n y fence a long t h e said l ine of rai lway for t h e accom­ modat ion of any person or for any purpose whatsoever ,

b u t

but t he said Authority m a y in his discret ion m a k e and m a i n t a i n such fences in connect ion with t he said l ine of

rai lway as he may t h i n k fit.
7 . The Cons t ruc t ing Au tho r i t y , and any person

author ised by h im, may use t h e said l ine or a n y p a r t

thereof, before i t is t ransferred to t he Chief Commis­

sioner for Rai lways and Tramways , and for t ha t purpose may r u n the reon any carr iages or waggons propelled or

d r a w n by any mot ive power.

SCHEDULE.

THIS railway, connecting the Great Western and North Western lines, commences at the junction of the Dubbo to Coonamble Railway at 277 miles 48 chains 26 links from Sydney, and proceeds northerly, for about 21/2 miles, on leaving which it branches off to the east, on the parallel to, and on the eastern side of the existing line to Coonamble

left or southern side of Talbragar River, and in the vicinity of the main road from Dubbo to Cobborah, to near Mitchell's Creek ; thence a north-easterly direction is taken and the following watercourses are crossed :—Mitchell's Creek at about 294 miles, Spicer's Creek at 304 miles, and Talbragar River at 312 miles, the latter at about 25 chains east of its confluence with Bomely Creek ; and after ascending that creek to its source, and passing about 7 miles west of Cobborah, the line surmounts the watershed at Mount Bangalore, and descends to and crosses Merrygoen Creek at about 5 miles east of Mendooran, and the eastern valley of the Castlereagh River is reached and followed up north-easterly along the authorised railway from Dunedoo to Coonabarabran for about 20 miles, to the crossing of Gambile Creek at about 358 miles; thence a more easterly direction is taken to the crossing of the Warrumbungle Range forming the boundary between the Counties of Napier and Pottinger, near 380 miles ; the spurs of

direction 18 continund to the crossing of Quirindi Creek, and onward the Liverpool Range are then skirted and the general north-easterly to the junction of the line with the North Western Railway at

435 miles 3 chains 43 links from Sydney via Dubbo, and 259 miles 43 chains 30 links from Sydney via Newcastle, and about 5 miles west of Werris Creek Junction, being a total distance of 157 miles 35 chains 17 links, and subject to such deviations and modifications as may be considered desirable by the Constructing Authority,
