1      Name of Plan

This Plan is Dubbo Local Environmental Plan 2011 (Amendment No 17).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to Lots 147 and 148, DP 754331, Warrie Road, Dubbo.

4 Amendment of Dubbo Local Environmental Plan 2011

Clause 7.12B

Insert after clause 7.12A—

7.12B

Dwelling houses on certain land at Warrie Road, Dubbo

(1)

This clause applies to Lots 147 and 148, DP 754331, Warrie Road,

Dubbo.

(2)

Despite any other provision of this Plan, development consent may be granted to development for the purposes of a dwelling house on land to which this clause applies if the consent authority is satisfied that—

(a)

the relevant development application provides for the consolidation of the land to which this clause applies into 1 lot, and

(b)

the dwelling house will be a manufactured home within the meaning of the Local Government Act 1993, and

(c)

the development will be ancillary to an approved intensive livestock agriculture use.
