Drugs, Poisons and Controlled Substances (Further
Amendment) Regulations 1996
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to include certain amendments made to the Commonwealth standard, in relation to selected containers and measure packs, containers for Schedule 5 poisons, other containers and the uniform paint standard, into the Drugs, Poisons and Controlled Substances Regulations 1995.
2. Authorising provision
These Regulations are made under section 132 of the Drugs, Poisons and Controlled Substances Act 1981.
3. Principal Regulations
In these Regulations the 1Drugs, Poisons and Controlled Substances Regulations 1995 are called the Principal Regulations.

4. Amendments to regulation 79
In regulation 79 of the Principal Regulations—
(a)
in sub-regulation (1) after "ampoule" insert "or pre-filled syringe"; and
(b)
in sub-regulation (2) after "plastic ampoule," insert "or a pre-filled syringe,".
5. Amendments to regulation 109A
In regulation 109A of the Principal Regulations, in the definition of "table 2 paint" in Table 2—
(a) before the item relating to "ETHYLENE insert—
"DICHLORO- more than 5 per METHANE cent by weight"; (methylene and chloride)
(b)
omit the item relating to "METHYLENE CHLORIDE (dichloromethane)".
6. Amendment to regulation 113(d)
In regulation 113(d) of the Principal Regulations, after "reclosed" insert "to prevent spillage of its contents".
7. Substitution of regulation 116
For regulation 116 of the Principal Regulations
substitute—'116. Immediate containers for Schedule 5
poisons
(1) A person must not sell or supply any one or
more of the following Schedule 5 poisons—
(a) methylated spirit(s); or
(b)
liquid hydrocarbons when packed as kerosene, lamp oil, mineral turpentine,

thinners, reducers, white petroleum
spirit or dry cleaning fluid; or
(c) petrol; or
(d) toluene; or(e) xylene—
in an immediate container unless the
container complies with either regulation
114 or regulation 115.Penalty: 50 penalty units.
(2) A person must not sell or supply a Schedule
5 poison (being a Schedule 5 poison not
listed in sub-regulation (1)) in an immediatecontainer unless—
(a)
the container complies with either regulation 114 or regulation 115; or
(b) the container—
(i) is readily distinguishable from a container in which food, wine or other beverage is sold or supplied;
and
(ii) has one or more of the following expressions—
"POISON"; or
"NOT TO BE TAKEN"; or
"NOT TO BE USED AS AFOOD CONTAINER"— embossed or indelibly written on it or,
in the case of a fibreboard container,
written on a paper label which cannot
be removed without damage to thecontainer.
Penalty: 50 penalty units.'.
