The Parliament of Victoria enacts:

1Purposes

The purposes of this Act are—

(a)to repeal Part X of the Drugs, Poisons and Controlled Substances Act 1981; and

(b)to amend that Act to close the Drug Rehabilitation and Research Fund established under Part X of that Act; and

(c)to provide for the transfer of all money standing to the credit of that Fund to the Consolidated Fund; and

(d)to repeal a spent transitional provision in the Confiscation Act 1997 related to the Drug Rehabilitation and Research Fund; and

(e)to make an amendment to the Drugs, Poisons and Controlled Substances (Amendment) Act 2006 in the nature of statute law revision.

2Commencement

(1)Sections 1 and 6 and this section come into operation on the day after the day on which this Act receives the Royal Assent.

(2)The remaining provisions of this Act come into operation on 1 July 2007.

3Repeal of Part X—Drugs, Poisons and Controlled Substances Act 1981

Part X of the Drugs, Poisons and Controlled Substances Act 1981 is repealed.

4New section 141 inserted—Drugs, Poisons and Controlled Substances Act 1981

At the end of Part XII of the Drugs, Poisons and Controlled Substances Act 1981 insert

"141Drug Rehabilitation and Research Fund

(1)On 1 July 2007—

(a)the Drug Rehabilitation and Research Fund is closed; and

(b)all money standing to the credit of the Drug Rehabilitation and Research Fund must be paid into the Consolidated Fund.

(2)In this section, Drug Rehabilitation and Research Fund means the trust fund established by section 124 of the Drugs, Poisons and Controlled Substances Act 1981 as in force immediately before 1 July 2007.".

5Repeal of transitional provision—Confiscation Act 1997

Section 157(10) of the Confiscation Act 1997 is repealed.

6Statute Law Revision—Drugs, Poisons and Controlled Substances (Amendment) Act 2006

In section 12 of the Drugs, Poisons and Controlled Substances (Amendment) Act 2006, in proposed new section 71D, after "quantity that is not less" insert "than".

7Repeal of Act

This Act is repealed on 1 July 2008.
