Drugs, Poisons and Controlled Substances

(Amendment) Regulations 1998

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to make further provision with respect to the sale or supply of certain poisons.

2. Authorising provisions

These Regulations are made under sections 33(2),
33(3), 129, 131,132 and 132B of the Drugs,

Poisons and Controlled Substances Act 1981.

3. Commencement

These Regulations come into operation on

31 December 1998.

4. Principal Regulations

In these Regulations the Drugs, Poisons and
Controlled Substances Regulations 19951 are
called the Principal Regulations.

5. Authorised persons

For item 1 of Column 1 of Part 1 of the Table to regulation 5(1) of the Principal Regulations, substitute—

"1. A person who holds or who is the agent of a

person who holds a licence, permit or warrant issued under the Act or these Regulations".

6. Exemption from permit for specialised supply

In regulation 18(2) of the Principal Regulations, at the end of paragraph (d) insert—

"; or

(e)

the Chief General Manager has specified circumstances for a medical condition in accordance with section 35A of the Act and if the medical practitioner is treating a person for that medical condition in those circumstances.".

7. Storage requirements

In regulation 56 of the Principal Regulations—

(a)

for "authorised under section 13(1) of the poisons" substitute "who, under the Act, whether or not by authority under section 13, sells or supplies any Schedule 7 poison"; and

(b)

for the words commencing with holder" in paragraph (b) substitute "supervision of that person or a person acting under his or her direction".

8. Records

In regulation 57 of the Principal Regulations, for
"authorised under section 13(1) of the Act or

licensed to sell or supply" substitute "who , under
the Act, whether or not by authority under

section 13, sells or supplies".

9. Lost or stolen poisons

In regulation 68 of the Principal Regulations, at the end of paragraph (c) insert—

"; or

(d)

sells or supplies any Schedule 7 poison by retail—".

10. Licences to sell or supply certain poisons

In regulation 72 of the Principal Regulations omit
"or Schedule 7 poison (other than a listed

regulated poison)".

11. Fees

In the Table to regulation 73 of the Principal

Regulations—

(a) omit item (h); and

(b)

in item (i) omit all words after "any Schedule 2 poison".
