Drugs, Poisons and Controlled Substances Amendment (Registered Aboriginal and Torres Strait Islander Health Practitioners) Regulations 2022

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Drugs, Poisons and Controlled Substances Regulations 2017 to enable registered Aboriginal and Torres Strait Islander health practitioners to lawfully possess and administer certain Schedule 4 poisons.

2Authorising provisions

These Regulations are made under sections 129, 132 and 132B of the Drugs, Poisons and Controlled Substances Act 1981.

3Principal Regulations

In these Regulations, the Drugs, Poisons and Controlled Substances Regulations 2017[1] are called the Principal Regulations.

4Definitions

In regulation 5(1) of the Principal Regulations insert the following definition—

"registered Aboriginal and Torres Strait Islander health practitioner means a person registered under the Health Practitioner Regulation National Law to practise in the Aboriginal and Torres Strait Islander health practice profession (other than as a student);".

5Persons authorised to possess Schedule 4, 8 and 9 poisons

In the Table in regulation 7(1) of the Principal Regulations, after item 25 insert

"26. A registered Aboriginal and Torres Strait Islander health practitioner. Those Schedule 4 poisons approved by the Secretary under regulation 160(1) that are required in the practice of the registered Aboriginal and Torres Strait Islander health practitioner's profession.".

6Secretary may approve Schedule 4 poisons for possession by certain persons

(1)In regulation 160(1)(i) of the Principal Regulations, for "364." substitute "364;".

(2)After regulation 160(1)(i) of the Principal Regulations insert

"(j)a registered Aboriginal and Torres Strait Islander health practitioner.".
