Drugs, Poisons and Controlled Substances Amendment (Monitored Poisons Database) Regulations 2020
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Drugs, Poisons and Controlled Substances Regulations 2017—
(a)to exempt registered medical practitioners, registered nurse practitioners and authorised suppliers from the requirement to check the monitored poisons database when prescribing and supplying monitored supply poisons to out-patients being treated in or discharged from a hospital and when discharging patients from a hospital; and
(b)to make minor technical amendments.
2Authorising provisions
These Regulations are made under sections 129(1) and 132 of the Drugs, Poisons and Controlled Substances Act 1981.
3Circumstances where it is not mandatory to check monitored poisons database—certain classes of person
(1)In regulation 132G(1) of the Drugs, Poisons and Controlled Substances Regulations 2017[1]—
(a)in paragraph (a), after "treated in" insert ", or discharged from,";
(b)in paragraph (b), after "treated in" insert ", or discharged from,";
(c)after paragraph (b) insert—
"(ba)an out-patient being treated in, or discharged from, a hospital; or".
(2)Regulation 132G(2) of the Drugs, Poisons and Controlled Substances Regulations 2017 is revoked.
