Drugs, Poisons and Controlled Substances Amendment (Continued Dispensing) Regulations 2022

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Drugs, Poisons and Controlled Substances Regulations 2017 to provide for a pharmacist to supply Schedule 4 poisons listed in the National Health (Continued Dispensing) Determination 2022 without a prescription and subject to certain conditions.

2Authorising provisions

These Regulations are made under sections 129, 132, 132A and 132B of the Drugs, Poisons and Controlled Substances Act 1981.

3Commencement

These Regulations come into operation on 18 October 2022.

4Principal Regulations

In these Regulations, the Drugs, Poisons and Controlled Substances Regulations 2017[1] are called the Principal Regulations.

5Definitions

In regulation 5(1) of the Principal Regulations, for the definition of National Health (Continued Dispensing) Determination 2012 substitute

"National Health (Continued Dispensing) Determination 2022 means the legislative instrument made under section 89A(3) of the National Health Act 1953 of the Commonwealth as formulated or published;".

6Sale or supply of Schedule 4 poison by pharmacist for continuity of treatment

In regulation 57(b) and (c) of the Principal Regulations, for "2012" substitute "2022".
