Drugs of Dependence (Amendment) Act 1991

An Act to amend the Drugs of Dependence Act 1989

[Notified in ACT Gazette S 7: 1 March 1991]

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Drugs of Dependence (Amendment) Act 1991.

Commencement

2.  (1)  Sections 1, 2 and 3 commence on the day on which this Act is notified in the Gazette.

(2)  The remaining provisions commence on a day, or respective days, fixed by the Minister by notice in the Gazette.

(3)  If a provision referred to in subsection (2) has not commenced before the end of the period of 6 months commencing on the day on which this Act is notified in the Gazette, that provision, by force of this subsection, commences on the first day after the end of that period.

Principal Act

3.  In this Act, “Principal Act” means the Drugs of Dependence Act 1989.1

Schedule 1

4.  Schedule 1 to the Principal Act is amended—

(a)by omitting the item relating to amylobarbitone and substituting the following item:

“Amylobarbitone, except when packed and labelled for injection............................................................... 20.00 20.00”;

(b)by inserting after the item relating to ecgonine the following item:

“Ethylamphetamine...................................................... 2.00 2.00”;

(c)by omitting the item relating to pentobarbitone and substituting the following item:

“Pentobarbitone, except when packed and labelled for injection............................................................... 20.00 20.00”; and

(d)by inserting after the item relating to phenazocine the following item:

“Phendimetrazine.......................................................... 5.00 5.00”.

Schedule 2

5.  Schedule 2 to the Principal Act is amended—

(a)by omitting the item relating to 1-methyl-4-phenyl-4-propionoxypiperidine (MPPP) and substituting the following item:

“1-Methyl-4-phenyl-4-piperidinol propionate (MPPP)........................................................................ 2.00 2.00”;

(b)by omitting the item relating to 1-phenylethyl-4-phenyl-4-acetoxypiperidine (PEPAP) and substituting the following item:

“1-Phenethyl-4-phenyl-4-piperidinol acetate (PEPAP)..................................................................... 2.00 2.00”; and

(c)by omitting the item relating to thiofentanyl and substituting the following item:

“Thiofentanyl................................................................. 0.005 0.005”.
