Drug Misuse and Trafficking Amendment (Prohibited Substances) Regulation 2016

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Drug Misuse and Trafficking Act 1985.

Explanatory note
The object of this Regulation is to amend the table of prohibited plants and drugs in Schedule 1 to the Drug

Misuse and Trafficking Act 1985 to:

(a)	prohibit certain psychoactive substances, including alprazolam, and
(b)	increase the threshold quantities of buprenorphine, and
(c)	exclude codeine, phenylpropanolamine and pseudoephedrine as prohibited substances to reflect the therapeutic or other use of those substances in accordance with the Poisons List under the Poisons and Therapeutic Goods Act 1966.

This Regulation is made under the Drug Misuse and Trafficking Act 1985, including sections 44 and 45 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Drug Misuse and Trafficking Amendment (Prohibited
Substances) Regulation 2016.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.
