Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Drug Misuse and Trafficking Act 1985.

Explanatory note
The object of this Regulation is to amend the Drug Misuse and Trafficking Regulation 2006 to provide that certain authorised officers of the Police Integrity Commission are exempt from a number of sections of the Drug Misuse and Trafficking Act 1985 relating to prohibited plants and prohibited drugs.
This Regulation is made under the Drug Misuse and Trafficking Act 1985, including section

45 (the general regulation-making power.)

1      Name of Regulation

This Regulation is the Drug Misuse and Trafficking Amendment (Police
Integrity Commission Exemption) Regulation 2008.

2 Amendment of Drug Misuse and Trafficking Regulation 2006

The Drug Misuse and Trafficking Regulation 2006 is amended by inserting the following after clause 5:

5A Exemption for Police Integrity Commission officers

(1)

An officer of the Police Integrity Commission who has been authorised by the Commissioner for the Police Integrity Commission for the purposes of this clause is exempt from the provisions of sections 10, 23 (1) and (2) and 25 (1) and (2) of the Act in relation to every prohibited plant or prohibited drug to the extent necessary to enable the officer to carry out his or her duties as such an officer.

(2) In this clause:
Commissioner for the Police Integrity Commission has
the same meaning as in the Police Integrity Commission
Act 1996.
officer of the Police Integrity Commission has the same
meaning as officer of the Commission has in the Police
Integrity Commission Act 1996.
