Drug Misuse and Trafficking Act 1985

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Drug Misuse and Trafficking Act 1985.

Explanatory note
The object of this Regulation is to amend the Drug Misuse and Trafficking

Act 1985 so as:

(a) to amend the description of several substances specified in the list of prohibited plants and drugs in Schedule 1 to the Act (being Dextropropoxyphene, Diphenoxylate and Tetrahydrocannabinol), and
(b) to add two substances to Schedule 1 (being 5-(2-aminopropyl)indan and Flunitrazepam).

These amendments largely reflect changes to the Poisons List proclaimed or proposed to be proclaimed under the Poisons and Therapeutic Goods Act 1966. This Regulation is made under the Drug Misuse and Trafficking Act 1985, including sections 44 and 45 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Drug Misuse and Trafficking Amendment

(Prohibited Plants and Drugs) Regulation 2000.

2 Commencement

This Regulation commences on 21 August 2000.

3 Amendment of Drug Misuse and Trafficking Act 1985

The Drug Misuse and Trafficking Act 1985 is amended as set out in

Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Insert after the matter relating to Alphaprodine:

Insert “except where Schedule Four of the Poisons List applies” after “Dextropropoxyphene” under the heading “Prohibited plant or prohibited drug”.

[3]      Schedule 1

Insert “Three or” after “Schedule” in the matter relating to Diphenoxylate under the heading “Prohibited plant or prohibited drug”.

[4]      Schedule 1

Insert after the matter relating to Fentanyl:

Flunitrazepam . . . . . . . . . . 0.6g 0.2g 1g 0.1kg 0.5kg

[5]      Schedule 1

Omit “except where separately specified in this Schedule” from the matter relating to Tetrahydrocannabinol under the heading “Prohibited plant or prohibited drug”.

Insert instead:

(b)

in hemp seed oil, containing 50mg/kg or less of tetrahydrocannabinols, when labelled “Not for internal use” or “Not to be taken”, or
