DRIVING INSTRUCTORS ACT 1992—REGULATION

(Relating to bush fire brigades)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Driving Instructors Act 1992, has been pleased to make the Regulation set forth hereunder.

The Driving Instructors Regulation 1993 is amended:

(a)

by inserting in clause 4 (2) after the words “State Transit Authority” the words “ , or to persons employed in the Department of Bush Fire Services,”;

(b) by inserting after clause 4 (2) the following subclause:

(3) A person who is employed, or otherwise engaged, to provide instruction to officers or members of bush fire brigades, or persons who hold positions under the Bush Fires Act 1949, for the purposes of their carrying out functions under the Bush Fires Act 1949 is not a driving instructor for the purposes of the Act when providing that instruction.

EXPLANATORY NOTE

The object of this Regulation is to give driving instructors of bush fire brigade officers and members, and of Departmental employees, the same exemption from the licensing requirements of the Driving Instructors Act 1992 as applies to driving instructors of fire brigade employees.

This Regulation is made under sections 4 (3) (Meaning of “driving instructor”) and 59 (Regulations) of the Driving Instructors Act 1992 (in particular section 59 (2) (i) which relates to exemptions).
