REGULATIONS UNDER THE DRIED FRUITS EXPORT CONTROL ACT 1924-1938.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Dried Fruits Export Control Act 1924-1938.

Amendments of the Dried Fruits Export Control Regulations.

Commencement

1. These Regulations shall be deemed to have come into operation on the twenty-ninth day of December, 1949.

Definitions.

2. Regulation 2 of the Dried Fruits Export Control Regulations is amended by inserting after the definition of “The Board” the following definition:—

“‘The Chairman’ means the Chairman of the Board;”.

Salaries of officers.

3. Regulation 3 of the Dried Fruits Export Control Regulations is amended—

(a) by inserting in sub-regulation (1.), after the word “or” (second occurring), the words “, where a maximum salary is also so set out,”;

(b) by omitting from that sub-regulation the words “the maximum set out in that Table opposite to that office” and inserting in their stead the words “that maximum”; and

(c) by omitting sub-regulations (2.), (3.), (4.), (4a.) and (5.) and inserting in their stead the following sub-regulation:—

“(2.) The Chairman may, if he is satisfied with the conduct, diligence and efficiency of an officer, grant to the officer such annual increments (if any) as are specified in the Table contained in the Schedule to these Regulations opposite to the office occupied by that officer, but so that the annual salary of the officer shall not exceed the maximum salary so specified.”.

4. Regulations 3a and 4 of the Dried Fruits Export Control Regulations are repealed and the following regulations are inserted in their stead:—

Conditions of employment of officers.

“4.—(1.) Subject to these Regulations, officers appointed by the Board shall be employed on the same conditions as to—

(a) leave of absence and holidays;

(b) costs of conveyance and travelling, meal and other allowances;

(c) attendance;

(d) performance of duties;

(e) hours of duty and overtime payment;

(f) salary marginal increases or allowances;

(g) variations of salary on account of variations in cost of living; and

(h) such other conditions of employment as are not prescribed in these Regulations,

as those prescribed by the Regulations for the time being in force under the Commonwealth Public Service Act 1922-1948 or determined by the Public Service Arbitrator under the Arbitration (Public Service) Act 1920-1947, as the case may be.

“(2.) For the purpose of the last preceding sub-regulation—

(a) where the Regulations for the time being in force under the Commonwealth Public Service Act 1922-1948 refer to powers and functions of the Public Service Board, those powers and functions shall be exercised by the Chairman when in Melbourne or, when he is not in Melbourne, by a member of the Board acting for the Chairman; and

(b) where those Regulations refer to the powers and functions of the Permanent Head or the Chief Officer, those powers and functions may be exercised by the Chairman or by such other officer or officers as the Chairman, in writing, appoints.

“(3.) Notwithstanding anything contained in sub-regulation (1.) of this regulation, an officer employed in the London Agency shall while travelling on duty in the United Kingdom be paid—

(a) hotel accounts for normal accommodation charges, including service charges of not more than fifteen per centum of those accommodation charges;

(b) One pound sterling per day for meals; and

(c) Ten shillings sterling per day for other expenses.

Entertainment allowance.

“4a. The Secretary to London Agency may, at the discretion of the Board, be paid an allowance, not exceeding Two hundred pounds per annum, for entertainment expenses.”.

Schedule.

5. The Schedule to the Dried Fruits Export Control Regulations is repealed and the following Schedule inserted in its stead:—
