DRIED FRUITS (AMENDMENT) ACT.

Act No. 42, 1957.

An Act to transfer to the New South Wales Dried Fruits Board control of the moneys received by it under the Dried Fruits Act, 1939, as amended by subsequent Acts; to authorise the said Board to invest surplus moneys so received by it; for these and other purposes to amend the said Act, as so amended; and for purposes connected therewith. [Assented to, 28th November, 1957.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of New South

Wales in Parliament assembled, and by the authority of the same, as follows :—

1 . (1) This Act may be cited as the "Dried Fruits (Amendment) Act, 1957".

(2) The Dried Fruits Act, 1939, as amended by subsequent Acts and by this Act, may be cited as the Dried Fruits Act, 1939-1957.

2.   The Dried Fruits Act, 1939-1951, is amended—

(a)

by omitting from paragraph (b) of subsection five of section six the word "Commission" and by inserting in lieu thereof the word "Minis te r" ;

(b) (i) by omitting from subsection five of section
fifteen the word " p e r s o n s " and by insert­
ing in lieu thereof the word " B o a r d " ;

(ii)   by omitting from subsection six of the same section the words "Minister or some person authorised by him in wr i t ing" and by insert­

ing in lieu thereof the word " B o a r d " ;

(c)

by omitting from section sixteen the words "an account in Special Deposits Account" and by inserting in lieu thereof the words " a bank in New South Wales to the credit of a separate account to be styled the 'Dried Fruits Account', and such account may be operated upon in such manner as the Board may from time to time determine";

(d ) . ( i ) by omitting from section seventeen the
words "shall be made available t o " and by

inserting in lieu thereof the words "may be

applied b y " ;
(ii) by inserting at the end of the same section the following new paragraph:—
Any moneys in the said account not immediately required for such purpose may be invested by the Board in any manner in which trustees are for the time being authorised to invest trust funds.

(e)

by omitting from subsection three of section eighteen the words "thirt ieth day of J u n e " and by inserting in lieu thereof the words "thir ty- first day of December";

by omitting from subsection two of section thirty-one the words "printed copy thereof shall be posted to every grower whose name appears on the roll of growers" and by inserting in lieu thereof the words "copy thereof shall as soon as practicable after the report has been so for- warded be exhibited in a position to which the public ordinarily has access in the Board's office and the Board shall cause such a copy to remain so exhibited until a copy of the next succeeding report prepared by the Board under subsection one of this section is exhibited in accordance with the provisions of this subsection".

3 . All moneys which immediately before the com- mencement of this Act were standing to the credit of the account established under section sixteen of the Dried Fruits Act, 1939, as amended by subsequent Acts, in Special Deposits Account shall as soon as may be after such commencement be paid by the Colonial Treasurer into the bank in New South AVales in which the Dried Fruits Account established under section sixteen of the Dried Fruits Act, 1939, as amended by subsequent Acts and by this Act, has been opened, to the credit of that account.
