REGULATIONS UNDER THE DRIED FRUITS ADVANCES ACT 1924-1926.

I, THE DEPUTY OF THE GOVERNOR-GENERAL in and over the Commonwealth, of Australia, acting with the advice of the Federal Executive Council, do hereby make the following Regulations under the Dried Fruits Advances Act 1924-1926, to come into operation forthwith.

DRIED FRUITS ADVANCES (REPAYMENT) REGULATIONS.

Short title

1. These Regulations may be cited as the Dried Fruits Advances (Repayment) Regulations.

Definitions.

2. In these Regulations unless the contrary intention appears—

“The Act” means the Dried Fruits Advances Act 1924-1926;

“The Board” means the Dried Fruits Advances Repayment Board;

“The Dried Fruits Advances Repayment Board” means the Board appointed under section 10a of the Act.

Application for release from indebtedness.

3. An application for release under section 10j of the Act shall be in accordance with Form A in the Schedule to these Regulations and shall be made to the Chairman of the Board.

Return to accompany application.

4. An applicant for release under section 10j of the Act shall furnish to the Chairman of the Board with his application a return in accordance with Form B in the Schedule to these Regulations in respect of each packing organization or export merchant to which or to whom he has delivered dried currants, dried lexias, or dried sultanas, during the years 1924, 1925 and 1926.

Application and return to be supported by declarations.

5. Each application for release under section 10j of the Act and each return made in pursuance of the last preceding regulation shall be supported by the declaration of the person making the application or return in accordance with the form set out in Form A and Form B, respectively, in the Schedule to these Regulations.

Declaration by packing organization or export merchant.

6. Each return made in pursuance of regulation four of these Regulations shall be supported by a declaration, in accordance with the form set out in Form B in the Schedule to these Regulations, by the Manager or a director ofthe packing organization or the export merchant, being a company, or by the export merchant to which or to whom the return relates.

Penalty for false statement in application or return.

7. Any person who wilfully makes any false statement in any application or return under these Regulations shall be guilty of an offence against these Regulations.

Penalty: Fifty pounds or imprisonment for three months.

Note.—Any grower who has not received from the proceeds of the sale of his dried fruits produced in the year 1925 an amount sufficient to repay any advance made to him under the “Dried Fruits Advances Act 1924” and provide for the maintenance of himself and family may make application in Form “A” and furnish a return or returns in Form “B” on or before the 1st September, 1926, for release either wholly or in part from his indebtedness in respect of the advance.

Note.—Regulation 7 of the Dried Fruits Advances (Repayment) Regulations provides as follows:—

“Any person who wilfully makes any false statement in any application or return under these Regulations shall be guilty of an offence against these Regulations.

Penalty: Fifty pounds or imprisonment for three months.

10. Amount of money in any bank, savings bank, building society or other financial institution. (State names and addresses of such institutions and amount of money in each)
11. Particulars of any money or property not previously disclosed. (The reply must include information as to money in hand, money lent, debentures, stock, bank or mining shares, or any other property)

 

12. Amount of any advances made to the applicant under any Act of any State (including Crown Lands Acts, Closer Settlement Acts, Discharged Soldiers’ Settlement Acts, and Advances to Settlers Acts) and the conditions under which such advances were made
13. Total net personal income of applicant from all sources during the calendar years 1925 and 1926 to the date of this application. (Income must include net personal returns from orchard or other investments in the form of house or land properties, money in bank, stocks, shares, war pension, annuities or from other sources)	1925 £

RETURN IN CONNEXION WITH APPLICATION FOR RELEASE FROM INDEBTEDNESS IN RESPECT OF ADVANCE.

If the grower delivered any dried currants or dried lexias or dried sultanas to more than one Packing Organization or Export Merchant during the years 1924, 1925 and 1926, it is necessary for him to complete a separate return in Form “B” in respect to each such Packing Organization or Export Merchant. (Additional copies of Form “B” may be obtained from any packing shed.)
