DRIED FRUITS.
No. 49 of 1967.
AN ACT to amend the Dried Fruits Act, 1947-1954.
[Assented to 24th November, 1967.]
BE it enacted, by the Queen's Most Excellent Majesty, by and with the advice and consent of
the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
Short title
| and citation. | 1. (1) This Act may be cited as the Dried Fruits |
Act Amendment Act, 1967.
(2) In this Act the Dried Fruits Act, 1947-1954 is
referred to as the principal Act.
(3) The principal Act as amended by this Act may
be cited as the Dried Fruits Act, 1947-1967.
Commence-

to be fixed by proclamation.

S. 9 repealed
| 3. Section nine of the principal Act is repealed | and |
| and re-enacted as follows | re-enacted. |
9. The elections of representatives of the Elections,

| 13. (1) The Minister may, in respect of any member of the Board, appoint a person to be the deputy of that member. | of deputies. |

| (2) A person so appointed has, in the event of the illness or absence of the member of whom he is the deputy, all the powers of that member during his illness or absence. | |
| (3) No act done by a deputy in that capacity shall be questioned in any proceedings on the ground that the occasion for the exercise by him of the powers of the member of whom he is the deputy had not arisen or had ceased. . |
5. The principal Act is amended by adding after s. 13A added.
section thirteen a section as follows-
| 13A. (1) The office of a member shall become Casual | vacancies. |
vacant if he—
(a) dies;
| (b) | resigns by written notice given to the Minister; |
| (c) | is removed from his office by the Governor for misbehaviour or mental or physical incapacity to perform his duties as a member; or |
| (d) | absents himself without permission of the Board from more than four consecutive meetings of the Board, and is declared by resolution of the Board to have forfeited his seat. |

(2) A member appointed to fill a casual vacancy on the Board shall hold office for the balance only of the term of the member in whose place he is appointed. .
