Application for variation of the Downer (Forbes/Narrandera Area) Enterprise Agreement 2019.
[1] An application has been made for approval of a variation to the Downer (Forbes/Narrandera Area) Enterprise Agreement 2019 (Agreement). The application was made by Downer EDI Works Pty Ltd (Employer) pursuant to s.210 of the Fair Work Act 2009 (Act).
[2] The application seeks to vary various clauses of the Agreement. The variation to the Agreement is attached to this decision and marked as Annexure A.
[3] The Employer previously provided written undertakings dated 30 June 2020. Those undertakings were accepted by this Commission in resolution of issues arising in respect of Pt.2-4 of the Act, and the Agreement was subsequently approved on 15 July 2020. A copy of those undertakings is attached to this decision and marked Annexure B.
[4] I remain satisfied that those undertakings will not cause financial detriment to any employee covered by the Agreement, and that the undertakings will not result in substantial changes to the Agreement. Those undertakings form part of the Agreement to be varied.
[5] Subject to the undertakings referred to above, and based on the material contained in the application and accompanying statutory declaration, I am satisfied that each of the requirements of ss.211 and 212 of the Act as are relevant to this application for approval of variation have been met.
[6] The variation is approved and the consolidated version of the Agreement, as varied and with undertakings, is attached to this decision.
[7] In accordance with s.216 of the Act, the variation operates from 23 October 2020.
