DEPUTY PRESIDENT MCCARTHY | PERTH, 22 OCTOBER 2013 |
Application for approval of the Downer EDI Engineering Power Pty Ltd BHPB Iron Ore Growth Projects Stage 1 Rail Construction AWU Greenfields Agreement.
[1] An application has been made for approval of an enterprise agreement known as the Downer EDI Engineering Power Pty Ltd BHPB Iron Ore Growth Projects Stage 1 Rail Construction AWU Greenfields Agreement (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act).
[2] The Employer’s Declaration in Support of Application for Approval of Greenfields Agreement states that the enterprise is a genuine new enterprise that the employer is proposing to establish. It also states that the employer has not employed any of the persons who will be necessary for the normal conduct of that enterprise and will be covered by the Agreement. I am therefore satisfied that the requirements of s.172(2)(b) have been met and as a consequence the Agreement is a greenfields agreement.
[3] I am satisfied that each of the requirements of ss.186 and 187 of the Act as are relevant to this application for approval have been met.
[4] As the Agreement does not contain a flexibility term, the model flexibility term is taken to be a term of the Agreement.
[5] As the Agreement does not contain a consultation term, the model consultation term is taken to be a term of the Agreement.
[6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from seven days from the date of this decision. The nominal expiry date of the Agreement is 13 December 2015.

CaseChat Overview and Summary
The primary legal issue the Fair Work Commission had to address was whether the proposed agreement contained terms that were fair and reasonable in all respects. The Commission had to assess the agreement against the relevant provisions of the Fair Work Act 2009, which required the agreement to meet certain criteria, including that it provide for fair and reasonable terms and conditions of employment, and that it be free from any terms that would undermine the health, safety or welfare of employees. The Commission also had to consider whether the agreement provided for adequate consultation and negotiation processes between the parties, and whether it complied with any relevant industry awards or other applicable laws.
In making its decision, the Fair Work Commission considered the submissions made by both parties, as well as relevant industry benchmarks and other comparable agreements. The Commission found that the proposed agreement met the requirements of the Fair Work Act and provided for fair and reasonable terms and conditions of employment for the workers involved in the project. The Commission also noted that the agreement provided for adequate consultation and negotiation processes, and that it complied with relevant industry awards and other applicable laws. As such, the Commission approved the proposed agreement, subject to certain conditions and modifications to ensure that it continued to meet the relevant legal requirements.
The final orders of the Fair Work Commission approved the proposed agreement between Downer EDI Engineering Power Pty Ltd and the AWU, subject to the conditions and modifications set out in the decision. The Commission also ordered that the agreement be registered with the Fair Work Commission, and that it be given effect as a registered agreement under the Fair Work Act. The decision provides important guidance for employers and unions seeking to negotiate and enter into enterprise agreements that meet the legal requirements and provide for fair and reasonable terms and conditions of employment for workers.
