AN ACT to amend the Door to Door (Sales) Act

1964-1980.

[Assented to 13 December 1983.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Door to Door

(Sales) Amendment Act 1983.

(2) In this Act the Door to Door (Sales) Act l',:ittged

1964-1980 is referred to as the principal Act.

The principal Act as amended by this Act may be cited as the Door to Door (Sales) Act 1964-1983.

2. This Act shall come into operation on a day

to be fixed by proclamation.

Section 2

amended.

3. Section 2 of the principal Act is amended

(a)

in subsection (1), in the definition of "credit purchase agreement" by deleting "or is payable not later than the end of the month next following the month in which the agreement is made"; and

(b)

by inserting after subsection (2) the fol- lowing subsection

(2a) For the purposes of sections 6

and 7B (5) of this Act

(a)

in determining whether a request is unsolicited no regard shall be had to the fact that the vendor or dealer had, by way of advertisement addressed to the public at large or a section of the public, solicited that request; and

(b)

where a request arises from a telephone call or other com- munication initiated by the vendor or dealer the request shall be deemed to have been solicited by the vendor or dealer, as the case may require. ".

Section 6

4. Section 6 of the principal Act is amended by deleting "a request" and substituting the fol- lowing

" an unsolicited request ".

5.    Section 7 of the principal Act is amended in ,%T;11Z.

paragraph (d) (i) of subsection (1) by deleting "the

request" and substituting the following-

" the unsolicited request ".

6.    Section 7B of the principal Act is amended in ,;;:liTecr.

subsection (5) by deleting "a request" and substitut-

ing the following-

" an unsolicited request ".
