CaseChat Overview and Summary
The primary legal issues before the commission were whether the agreement complied with the relevant provisions of the Fair Work Act 2009, particularly in relation to the provisions that ensure fair and reasonable terms and conditions for employees. The employer contested the agreement's validity on the basis that it did not meet the statutory requirements for certified agreements, specifically pointing to concerns about the agreement's procedural fairness and its compliance with the 'better off overall test.'
The commission examined the agreement in detail, considering the balance of rights and obligations, and the overall fairness of the terms. The commission noted the importance of certified agreements in providing a fair framework for employee relations, particularly in sensitive areas such as domestic violence support services. Ultimately, the commission determined that the agreement met the statutory requirements for approval. It found that the agreement provided for fair and reasonable terms and conditions for employees and was better off overall for the employees compared to the applicable awards.
The Fair Work Commission approved the Domestic Violence Action Centre Inc. Certified Agreement 2017, thereby resolving the dispute and setting a precedent for the terms and conditions of employment within the organisation. This decision underscores the commission's commitment to ensuring that certified agreements in sensitive sectors like domestic violence support are fair, reasonable, and beneficial for employees.
