An Ordinance to provide further remedies

for the annoyance arising from dogs.

WHEREAS the annoyance and injuries arising from Dogs have

been increasing of lateyears ; and whereas it is expedient ttal:Imsetnhd No. 14

to provide a remedy for the same, and for such purpose to amend certain portions of an Act passed in the fourth and fifth years of the reign of Her present Majesty entitled "an Act to remove the annoyance occasioned by dogs in the colony of Western A ustralia;—Be it therefore enacted by His Excellency the Governor of Western Australia and its

Dependencies, by and with the advice and consent of the Legislative Council thereof, that the fees payable on the issue of the licence re- quired by the said Act shall be as set forth in the Schedule hereunto annexed.

No dogs to be ezempted• II. AND be it enacted, that the sixteenth clause of the said Act,

whereby certain Dogs are exempted from the operation of the said Act,

is hereby repealed.

Unlicensed Dogs may be III. AND be it enacted, that it shall be lawful for any constable, destroyed. or for any other person generally or specially authorised in writing

so to do by a Justice of the Peace, to destroy any unlicensed dog without any notice given to the owner of SUM dog, or to any other person whatever.

Giving Dogs to Natives W. AND be it enacted, that any person who shall be convicted of

finable, giving a dog to an Aboriginal Native of this colony, shall forfeit and

pay for every such offence any sum not less than twenty shillings nor

exceeding ten pounds.

Meaning of the word dog. V. AND be it enacted, that in this Ordinance the word dog

do shall

be taken to mean any animal of the canine species, unless where spe-

cial provision is made to the contrary.

Parts of 4th and 5th VI. AND be it enacted, that all the provisions of the Act above

form

mentioned respecting the jurisdiction of Justices, and respecting the proof of ownership and of licence, and the limitation of prosecutions, and the recovery and appropriation of fees, fines, and penalties, shall be taken and deemed to be applicable to this Ordinance.
