PART I

PRELIMINARY

Citation

1. These regulations may be cited as the Dog Control Regulations, 1990.

Commencement

2. These regulations will come into operation on 30 June, 1990.

Revocation

3. All regulations previously made under the Dog Control Act, 1979, are revoked.

Interpretation

4. (1) In these regulations—

"the Act" means the Dog Control Act, 1979:

"prescribed person" means—

(a)

a person who holds a current pensioner health benefits or concession card issued by the Commonwealth;

(b)

a person who holds a current State concession card issued by the Department for Community Welfare;

(c)

a totally and permanently incapacitated disability pensioner;

(d)

a British Commonwealth Service Pensioner in receipt of a pension from, and assessed as eligible by, the Commonwealth Department of Veteran Affairs; or

(e)

a person who is in receipt of Commonwealth unemployment or sickness benefits or State financial assistance.

(2) For the purposes of the definition of "metropolitan council" in section 5(1) of the Act, each of the councils specified in schedule 1 is a metropolitan council.

(3) For the purposes of the definition of "prescribed private pound" in section 5(1) of the Act, The South East Animal Welfare League Inc. is a prescribed body.

Fees and charges

5. The fees and charges payable for the purposes of the Act and these regulations are set out

in schedule 3.

Forms

6. The forms to be used for the purposes of the Act and these regulations are set out in

schedule 4.

PART II

ADMINISTRATION

Payments to Minister: s. 12(3)

7. Each metropolitan council must forward to the Minister, on or before 31 July in each year, payment of an amount equal to 20 per cent of the dog registration fees received by the council in the preceding financial year, together with a statement in the prescribed form of the fees received during that period.

Prescribed private pounds

8. Where a council has entered into an arrangement for the purposes of the Act with a body operating a prescribed private pound, the council must pay to that body the prescribed fee for each dog that is detained by the council under the Act at that pound.

PART III

REGISTRATION

Basis for calculating registration and renewal fees

9. (1) For the purpose of determining the fee appropriate to an application for registration, or renewal of registration, of a dog, the registrar to whom the application is made may, subject to subregulation (3), require the applicant to produce evidence supporting the applicant’s claim as to the basis on which the fee should be calculated.

(2) Where—

(a)

an application for registration, or renewal of registration, of a dog is made on or after 1 June, 1991;

(b)

the applicant claims that the registration or renewal fee should be calculated on the basis that the dog has been desexed;

and

(c)

in the case of an application for renewal of registration of a dog, the certificate of registration of the dog does not indicate that the dog has been desexed,

the application must be accompanied by a certificate (in the prescribed form) of a veterinary

surgeon certifying that the dog has been desexed.

(3) Where an application for registration, or renewal of registration, of a dog is accompanied by a certificate of a kind referred to in subregulation (2), the applicant cannot be required to produce further evidence supporting the applicant’s claim that the fee should be calculated on the basis that the dog has been desexed.

Registration disc: s. 28(1)

10. A registration disc issued pursuant to the Act—

(a)

must display the period of registration, the registered number of the dog and the area number assigned to the council under schedule 2;

and

(b)

must consist of such material, and be of such size, shape and colour, as may be approved by the Minister in respect of the period of registration.

Registers: s. 30(1)

11. A register maintained by a council pursuant to section 30 of the Act—

(a)

must contain the information included in each current certificate of registration of a dog issued by the registrar for the area of the council;

and

(b)

may consist of copies or duplicates of the certificates of registration or may be kept in any other form, including computerized form, that enables access to the information included in those certificates.

Change in registered owner: s. 32(1)

12. (1) An application for registration of a dog in the name of a person other than the person in whose name the dog is currently registered must be made by completing and signing the form for that purpose set out in the current certificate of registration for the dog and producing the certificate to the registrar.

(2) The registrar must, when registering a dog in another person’s name, issue to that other person a new certificate of registration and, if necessary, a new registration disc for the dog.

Rectification of register: s. 32(2)

13. An application for rectification of a register may be made by instrument in writing lodged with the registrar.

Registration of change of address

14. (1) Where a registered dog is removed from the place recorded in the certificate of registration as the place at which the dog is usually kept with the intention that it will be usually kept at some other place in the same area or in a different area, the person in whose name the dog is registered must, within 14 days after the dog is so removed, apply for registration of the address of the place at which the dog will now be usually kept.

Penalty: Division 10 fine.

(2) An application for registration of a change of address must—

(a)

be made to the registrar for the area in which the dog will be usually kept;

(b)

be made by completing and signing the form for that purpose set out in the current certificate of registration for the dog and producing the certificate to the registrar;

and

(c)

be accompanied by the prescribed fee.

(3) The registrar must, when registering a change of address—

(a)

issue a new certificate of registration, or endorse the new address on the current certificate, as the case may require;

and

(b)

if necessary, issue a new registration disc for the dog.

Collars and registration discs—exemption: s. 33(2)(d)

15. Section 33 does not apply in relation to—

(a)

a dog that has a slip chain collar around its neck to which is attached a chain, cord or leash held by a person;

(b)

a dog (other than a guard dog) that is in a place other than a public place and in respect of which all reasonable measures have been taken by the person responsible for its control to prevent it wandering from that place.

PART IV

CONTROL OF DOGS

Seizure of dogs wandering at large: s. 36

16. (1) Where a dog is seized under section 36 of the Act within the area of the Outback Areas Community Development Trust and is not forthwith returned to the person responsible for its control, it may be detained in any suitable premises.

(2) For the purposes of section 36(5)(a) of the Act, the notice referred to in that section must

be exhibited—

(a)

if it is given in relation to a dog seized within the area of a council other than the Outback Areas Community Development Trust, at the office of the council for that area;

(b)

if it is given in relation to a dog seized within the area of the Outback Areas Community Development Trust, at the police station nearest to where the dog was seized.

Laying poison in baits for dogs: s. 46(4)

17. For the purposes of section 46(4) of the Act, the following requirements must be complied with if poison is to be laid on land:

(a)

before the poison is laid, notice in writing must be served—

(i)

on the owner or occupier of any adjoining land; and

(ii)

on—

(A)

in the case of land situated within the area of the Outback Areas Community Development Trust—a member of the police force on duty at the nearest police station;

or

(B)

in any other case—the council for the area in which the land is

situated,

specifying each place at which, and the period for which, the poison will be laid;

(b)

notices bearing the warning "POISON LAID ON THIS PROPERTY" must be displayed on the land for a period commencing not less than 48 hours before, and expiring not less than 14 days after, the poison is laid;

(c)

at least one such notice must be displayed in a conspicuous position as near as practicable to each boundary of the land that abuts a road so as to be clearly and easily read by persons using the road;

(d)

a further such notice must be displayed at the main entrance to the land so as to be clearly and easily read by persons using that entrance;

(e)

the warning on each such notice must be in capital letters not less than 55mm in height, in red on a white background.

Notice of intention to destroy dog as danger to health: s. 47(5)

18. Where an authorized person proposes to destroy a dog pursuant to section 47 of the Act, notice in writing in the prescribed form must be given as soon as practicable to the owner.

Guard dogs

19. (1) Where a guard dog is kept at particular premises for the purpose of guarding or protecting a person or property at those premises, the person in whose name the dog is registered must—

(a)

notify an authorized person for the area in which the premises are situated of—

(i)

the address of the premises;

(ii)

the times and periods during which the dog will be kept at the premises for that purpose;

and

(iii)

a telephone number on which a person who is responsible for the control of the dog can be contacted at any time in relation to the dog;

and

(b)

ensure that there is displayed in a conspicuous position at the premises at all times while the dog is at the premises for that purpose a telephone number on which a person who is responsible for control of the dog can be contacted at any time in relation to the dog.

Penalty: Division 10 fine.

(2) Notice under subregulation (1)(a)

(a)

must be given within 24 hours after the dog is first kept at premises as referred to in that subregulation or, if the dog is so kept at the commencement of these regulations, within 14 days after that commencement;

(b)

may be given orally or in writing.

PART V

MISCELLANEOUS

Appeals: ss. 47(5) and 58(8)

20. (1) An appeal pursuant to section 47(5) or 58(8) of the Act may be instituted by filing at the appropriate court a notice of appeal in the form prescribed under the Magistrates Court (Civil) Rules 1992 setting out particulars of the decision appealed against and the grounds on which the appeal is based.

(2) The appeal must be instituted within seven days after service of notice of the decision of the authorized person or council appealed against.

(3) The appellant must, within 48 hours of filing a notice of appeal, serve a copy of the

notice—

(a)

in the case of an appeal pursuant to section 47(5) of the Act, on the authorized person whose decision is appealed against;

(b)

in the case of an appeal pursuant to section 58(8) of the Act, on the council whose decision is appealed against.

Destruction applications: s. 50(2)

20A. (1) An application for an order for destruction of a dog pursuant to section 50(2) of the Act may be made by filing at the appropriate court an application in the form prescribed under the Magistrates Court (Civil) Rules 1992 setting out—

(a)

a description of the dog; and

(b)

the dog’s registered number, if known; and

(c)

the name and address of the owner of the dog, if known; and

(d)

the grounds of the application.

(2) The applicant must, within 48 hours of filing an application, serve the owner of the dog with a copy of the application.

Expiation of offences: s. 64(1)

21. For the purposes of section 64(1) of the Act, an offence against any of the following provisions is a prescribed offence:

(a)

section 26(1), 33(1), 35(1), 39(1), 40, 41, 43 or 48(1) of the Act;

(b)

regulation 14(1) or 19(1).

Service of notices

22. A notice or order required or authorized by the Act or these regulations to be given to a person may be given—

(a)

by delivering it personally to the person or, in the case of a body corporate, to the manager or secretary of the body corporate;

(b)

by leaving it for the person at his or her place of residence or business with someone apparently over the age of 16 years or in a letterbox to which it would have been delivered if sent by post;

or

(c)

by posting it to the person at his or her last known address.
