AN ACT to amend the Dog Act, 1903-1965.

[Assented to 23rd October, 1967.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

Short title.

I. (1) This Act may be cited as the Dog Act

and citation.

Amendment Act, 1967.

In this Act the Dog Act, 1903-1965, is Reprinted in

the

referred to as the principal Act.

This Act shall come into operation on a date

to be fixed by proclamation.

Section twenty-one A of the principal Act

is amended

(a)

by substituting for the word, "The" in line one, the passage, "(1) Subject to subsec- tions (2) and (3) of this section, the";

(b)

by adding after the word, "a" in line three the words, "food shop or a";

(c)

by adding after the penalty, subsections as follow

(2) Subject to subsection (3) of this section, the owner of a dog which is found in any food shop within any city, town or townsite commits an offence.

Penalty: For a first offence ten dollars, and for a second or any subsequent offence, twenty dollars.

(3) Notwithstanding anything in any Act, regulation or by-law, a person who is blind or partially blind

(a)

is entitled to be accompanied by

a dog bona fide used by him as a

guide dog, in any building or place open to or used by the public for any purpose or in any public transport; and

(b)

is not guilty of an offence by reason only that he takes that dog into or permits that dog to enter any building or place open to or used by the public or on any public transport.

(4) In this section

"food shop" means any premises in which any commodity used for food or drink by man is sold, offered for, or exposed for, sale;

"guide dog" means a dog trained by a guide dog training institution recognised by the Guide Dogs for the Blind Association of Western Australia Incorporated and used as a guide by a person who is blind or partially blind.
