DOG ACT 1966—REGULATION

(Relating to the registration of dogs)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Dog Act 1966, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 September 1993.

Amendments

2. The Dog Regulation 1981 is amended:

(a) by omitting from clause 13 the matter “(a)”;

(b) by inserting after clause 13 the following clause:

Reduction of registration fee for desexed dogs

13A. If the person applying for the registration of a dog:

(a) lodges with the registration clerk of the council of the area in which the dog is intended to be ordinarily kept a statutory declaration, or a certificate signed by a veterinary surgeon, to the effect that the dog has been desexed or is permanently incapable of reproduction; or
(b) otherwise satisfies the council that the dog is desexed or incapable of reproduction,

the registration fee for the dog is to be reduced to one-third of the general registration fee (disregarding any fraction of a cent) applicable in that area.

(c) by omitting from clauses 14 and 15 the matter “(a) or (b)” wherever occurring;
(d) by omitting from clause 15 the matter “clause 14” and by inserting instead the matter “clause 13A or 14”;
(e) by inserting after clause 15A the following clause:

Period of registration

15B. For the purposes of section 14 (3) of the Act, the registration of a dog is in force from the date on which the appropriate registration clerk issues the registration badge in respect of the dog and expires:

(a) if the registration badge is issued in a month other than
September in any year—on the next following date of 30
September; or
(b) if the registration badge is issued in the month of

September in any year—on 30 September in the following year.

(f)

by omitting from Form 4 in Schedule 1 the matter “$100” and by inserting instead the matter “$500”;

(g)

by omitting from the notes to Form 4 in Schedule 1 the words “Section 14 (1B) (b) of the Dog Act 1966” and by inserting instead the words “Clause 13A of the Dog Regulation 1981”.

EXPLANATORY NOTE

The object of this Regulation is to amend the Dog Regulation 1981 as a consequence of certain amendments to the Dog Act 1966 contained in the Dog (Amendment) Act 1993 relating to the registration of dogs. Clauses 13A and 15B above merely restate existing provisions of the Dog Act 1966 in relation to the period of registration of dogs and the reduction of the registration fee for desexed dogs.

This Regulation is made under the Dog Act 1966, including sections 14 (1B) and
(3) and 27 (the general regulation-making power, in particular, section 27 (cl)).
