  1. The applicant seeks special leave to appeal from a decision of the Full Court of the Federal Court of Australia (Rares, Thomas and Snaden JJ) dismissing an appeal from a decision of the Federal Court of Australia (Collier J) which dismissed an application for judicial review of a decision of the Administrative Appeals Tribunal.

  2. The application does not enjoy sufficient prospects of success to warrant a grant of special leave to appeal, nor is it a suitable vehicle to deal with the question of principle raised. Accordingly, it would be futile to grant the extension of time necessary for the application to proceed.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
