AN ACT to further amend the Dividend Duties Act, 1902.

[Assented to 31st December, 1924.]

E it enacted by the King's Most Excellent Majesty, by n and with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the Dividend Duties Act Short:title.

Amendment Act, 1924, and shall be read as one with the Divi- dend Duties Act, 1902, hereinafter referred to as the prin- cipal Act.

Amendment of

The words " and verified by a statutory declara- tion," in paragraph (a) of Subsection (1) of Section 6 are omitted and a subsection is inserted in section six of the principal Act, as follows :- section 13.

(9.) A mining company other than a coal min- ing company shall not be liable to pay duty on profits made after the 30th day of June, 1924, until such profits shall have equalled so much of the share capital of the company (if any) as may have been paid up in cash after that date; and duty shall only be pay- able on the assessed profits of the company so far as, from the 30th day of June, 1924, such profits exceed the amount of the share capital paid up in cash after such date.

3. (1.) Section 8 of the principal Act is amended by rectrod iim sgn ,earand

tion," in paragraph (a) of Subsection (1).

(2.) Section 8a of the principal Act (inserted by Act No. 22 of 1918) is amended by omitting the words " verified by statutory declaration," in paragraph (a) of Subsec- tion (1).

(3.) Section 9 of the principal Act is amended by omitting the words " and may require such balance sheets and documents to be verified by statutory declaration."

Amendment of

A paragraph is inserted in Section 21 of the principal Act, as follows :-

aection 21. 4.

(d) Transmits to the Commissioner of Taxation a return, balance-sheet, or document containing a false statement to evade or attempt to evade duty.

Amendment of

subsection (1) of 5. Subsection (1) of Section 29 of the principal Act

section 29.	is repealed.
Section 30.

Amendment of 6.

Section thirty of the principal Act is amended by in-

serting in line three thereof, in place of the words "the

duty," the words "one-fourth of the duty."

Reprinting of the 7.

All copies of the principal Act to be hereafter printed by the Government Printer shall be printed as amended by this Act, under the superintendence of the Clerk of Parlia- ments.
