AN ACT to amend " The District Roads Act,

1871 " (34 Vic., No. 26).

[ Assented to, 6th September, 1880.

HEREAS it is expedient to provide greater facilities than at

Roads in this Colony : Be it therefore enacted by His ExcellencyWpresent exist for the declaration of Main and Minor

the Governor of Western Australia and its Dependencies, by and with the advice and consent of the Legislative Council thereof, as follows:—

1 IT shall be lawful for the Governor, upon the application of may appoint Main

roads or parts of roads shall be main or minor roads ; and every such appointment, on the like application, from time to time to revoke; and every such appointment or revocation shall be published in the Government Gazette.

2 SECTION 43 of the said Act is hereby amended by inserting

34th Viet., No. 26, s. 43 the words "for at least twenty years," in the second line, after the

amended.

word "public," and by omitting the word " committee," in the third line of the section, and inserting the words "local board of the district in which such track is situate."

Definition of the 3 THAT the word " track," used in section 43 of the said Act,

"track." word shall mean a track which has been ordinarily used by wheeled

vehicles, carts, or carriages.

Previous appointments of notified in the Government Gazette as Main and Minor roads,Main and Minor Roads 4 AND whereas many roads of the Colony have been publicly

confirmed. notwithstanding that the time within which such roads ought to

have been so gazetted under the provisions of "The District Roads Act, 1871," had elapsed, be it enacted that all roads which have at any time since the passing of the said Act been publicly notified in

the Government Gazette as Main or Minor roads shall be deemed and

taken to be respectively Main and Minor roads within the meaning

of the said Act.
