2 District Courts (Court Fees) No. 443, 1992 ˙ Short title 1. This order in council may be cited as the District Courts (Court Fees) Order 1992 . ˙ Commencement 2. This order in council commences on 1 January 1993. ˙ Fees determined 3. The fees set out in Schedules 1 and 2 are determined for the purposes of section 102 of the Act. ˙ Application 4.(1) Schedule 1 applies to continuing civil proceedings started before 1 October 1982. (2) Schedule 2 applies to civil proceedings started on or after 1 October 1982. (3) Items 4 to 28 and 32 to 39 of Schedule 2 also apply to continuing civil proceedings started before 1 October 1982. ˙ Repeal 5. The order in council made under the Act and published in the Gazette on 17 August 1991 at pages 2058 to 2064 (1991 SL No. 49) is repealed.

10 District Courts (Court Fees) No. 443, 1992 SCHEDULE 2 (continued) 37 (1) For each person left in possession—the amount actually paid, but not more than—for each day . . . . . (2) If board and lodging are not supplied—the expenses that the Registrar considers were actually and reasonably incurred. (3) Other actual and necessary payments made by the Registrar to secure the safe custody of property under seizure are also allowable. (4) No fee is payable for the custody and possession of property under seizure if the property is not kept in the actual possession of the Registrar or the bailiff. 38 (1) The Registrar may require a deposit on account of the fees applicable to a proceeding under warrant— (a) before the proceeding is commenced; or (b) at any time during the course of the proceeding. (2) The Registrar must deliver a memorandum of the amount deposited to the party making the deposit. 39 (1) Allowance for time necessarily spent after the first hour on— (a) service of a plaint, summons, subpoena or other process or execution of a warrant; or (b) arranging or conducting an auction; each hour or part of an hour . . . . . . . . . . . . . . . . . . . .
