r 1 17 r 4 District Court Rules 1968 DISTRICT COURT RULES 1968 [as amended by all amendments that commenced on or before 22 January 1999] PART 1—PRELIMINARY ˙ Short title 1. These rules may be cited as the District Court Rules 1968 . ˙ Interpretation 3. In these rules— “books” include any register and any other record of information however compiled, recorded or stored. “foreign court” means the Court of a district into which process is issued from another Court. “foreign district” means the district into which process is issued from another district. “home court” means the Court from which process is originally issued. “home district” means the district from which any process is originally issued. “trial” means the trial of the action or the hearing of any matter in court. ˙ When practice not prescribed 4.(1) Where the rules of the Supreme Court provide for a remedy, procedure, or power which may be granted, applied, or exercised whether before, at, or after judgment in the course of proceedings of a type which may be heard and determined in a District Court and such remedy, procedure, or power is not provided for in these rules, the rules of the Supreme Court relating to such remedy, procedure, or power shall, with all the necessary adaptations, apply to such proceedings in a District Court.
r 5 18 r 9 District Court Rules 1968 (2) In any case when the manner or form of procedure is not prescribed or is insufficiently prescribed by these rules or by the practice of the Court, any party may apply to a judge for directions and any step taken or thing done in accordance with the directions given by the judge shall be deemed to be regular and sufficient. ˙ Effect of noncompliance 5. Noncompliance with any of these rules or with any rule of practice for the time being in force, shall not render any proceedings void unless the court or a judge so directs; but such proceedings may be set aside either wholly or in part as irregular, or amended, or otherwise dealt with in such manner and upon such terms as the court or judge may think fit. ˙ Forms 6.(1) The forms in schedule 1 or, if appropriate, in the Rules of the Supreme Court , schedule 1 must be used for all actions, matters or proceedings. (2) A reference in these rules to a form by number is a reference to the form of the corresponding number in schedule 1. ˙ Solicitors 8. Where by the Act, or these rules, any act may be done by any party, such act may be done either in person or by the party’s solicitor, save where otherwise specially provided. PART 2—WHERE PROCEEDINGS MAY BE COMMENCED ˙ Jurisdiction 9. The district in which an action shall be commenced shall be— (a) the district within which the defendant, or 1 of 2 or more
r 10 19 r 12 District Court Rules 1968 defendants, as the case may be, resides or carries on business; or (b) the district within which the cause of action or claim, either wholly or in some material point, arose; or (c) the district within which by an engagement or promise in writing given by the defendant a debt or sum of money is made payable. ˙ Action deemed to commence in correct district 10.(1) If a person served with a plaint in an action fails to file an entry of appearance and defence as hereafter provided or fails to file together with such an entry of appearance and defence a notice that the person asserts that the action was not commenced in a district hereby prescribed the action shall be deemed to have been commenced in a district hereby prescribed. (2) If any such notice be filed together with an entry of appearance and defence any judge may upon application in chambers determine whether the action was commenced as hereby prescribed. ˙ Rules and practice to apply 11. Where the parties, in pursuance of section 72 of the Act agree to the trial of an action in a District Court, a plaint shall be issued thereon and in such cases, the rules and practice of the court shall apply so far as the same can be applied. ˙ Jurisdiction—defendant outside State 12. Where a plaintiff has a cause of action in respect of which a District Court would have jurisdiction had the defendant been within the State, and the defendant is outside the State, the plaintiff may issue a plaint out of such District Court.
r 13 20 r 15 District Court Rules 1968 PART 3—PARTIES TO ACTIONS ˙ Persons claiming jointly, severally, or in the alternative may be plaintiffs 13.(1) All persons in whom any right to relief in respect of or arising out of the same transaction or series of transactions is alleged to exist, whether jointly, severally, or in the alternative, may be joined in an action as plaintiffs, provided that the case is such that if such persons brought separate actions some common question of law or fact would arise. (2) However, the court or a judge may, in any case in which separate and distinct questions arise, order that separate plaints be filed, or separate trials had, or may make such other order as may be just. (3) When several plaintiffs are joined in an action, judgment may be given for such 1 or more of them as is or are entitled to relief for such relief as the plaintiff or plaintiffs may be entitled to, without any amendment. (4) But the defendant shall be entitled to the defendant’s costs occasioned by joining as a plaintiff any person who is not entitled to relief, unless the court or a judge in disposing of the costs otherwise directs. ˙ Action in name of wrong plaintiff 14. When an action has been commenced in the name of the wrong person as plaintiff, or it is doubtful whether an action has been commenced in the name of the right plaintiff, the court or a judge may order that any other person be substituted or added as plaintiff upon such terms as may be just. ˙ Counterclaim—misjoinder 15. When any person has been improperly or unnecessarily joined as a plaintiff in an action, the defendant shall be entitled to the same relief by way of counterclaim or set-off against the other plaintiffs or any of them, as if such person had not been so joined, notwithstanding such misjoinder or any proceeding consequent thereon.
r 16 21 r 20 District Court Rules 1968 ˙ Persons to be joined as defendants 16.(1) All persons may be joined as defendants against whom the right to any relief is alleged to exist, whether jointly, severally, or in the alternative. (2) And judgment may be given against such 1 or more of the defendants as may be found to be liable, according to their respective liabilities, without any amendment. ˙ Joinder of parties by leave 17. Notwithstanding rules 13 and 16, but without prejudice to any of the powers of the court or a judge under this part, 2 or more persons may be joined together in 1 action as plaintiffs or as defendants with the leave of the court or a judge. ˙ Defendant need not be interested in all the relief claimed 18. It shall not be necessary that every defendant shall be interested as to all the relief claimed in the action, or as to every cause of action included in the action; but the court or a judge may make such order as may be just to prevent any defendant from being embarrassed or put to expense by being required to attend any proceedings in which the defendant has no interest. ˙ Joinder of person severally or jointly and severally liable 19. The plaintiff may, at the plaintiff’s option, join as parties to the same action all or any of the persons severally, or jointly and severally, liable on any 1 contract, including parties to bills of exchange and promissory notes. ˙ Plaintiff in doubt as to person from whom redress is to be sought 20. When a plaintiff is in doubt as to the person from whom the plaintiff is entitled to relief, the plaintiff may join 2 or more persons as defendants, to the intent that the questions as to which (if any) of the defendants is liable, and as to what relief the plaintiff is entitled to, may be determined as between all parties.
r 21 22 r 23 District Court Rules 1968 ˙ Trustees, executors etc. may sue and be sued as representing estate 21. Trustees, executors, and administrators may sue and be sued on behalf of or as representing the property or estate of which they are trustees or representatives, without joining any of the persons beneficially interested in the trust or estate, and shall be considered as representing such persons; but the court or a judge may, at any stage of the proceedings, order any of such persons to be made parties, either in addition to or in lieu of the previously existing parties. ˙ Numerous persons 22. When there are numerous persons having the same interest in the subject matter of an action or matter 1 or more of such persons may sue, and the court or a judge may authorise 1 or more of such persons to be sued, or may direct that 1 or more of such persons shall defend, in such action or matter, on behalf or for the benefit of all persons so interested. ˙ Misjoinder and nonjoinder—striking out and adding parties—consent of plaintiff or next friend 23.(1) The court shall not refuse to determine an action or matter by reason only of the misjoinder or nonjoinder of parties, and the court may in every cause or matter deal with the matter in controversy so far as regards the rights and interests of the parties actually before it. (2) The court or a judge may, at any stage of the proceedings, either upon or without the application of either party, and on such terms as may appear to the court or judge to be just, order that the names of any persons improperly joined, whether as plaintiffs or as defendants, be struck out, or that the names of any persons who ought to have been joined, or whose presence before the court may be necessary in order to enable the court effectually and completely to adjudicate upon and settle all the questions involved in the cause or matter, be added, either as plaintiffs or defendants. (3) But no person shall be added as a plaintiff suing without a next friend or as the next friend of a plaintiff under any disability, without the person’s own consent in writing thereto.
r 24 23 r 28 District Court Rules 1968 ˙ Application to strike out 24. An application to add or strike out or substitute a plaintiff or defendant may be made to the court or a judge, at any time before the hearing of the action, or may be made at the hearing in a summary manner. ˙ When defendant added 25.(1) When a defendant is added or substituted, the defendant shall, unless the defendant waives such service, be served with the amended plaint or other process, and the proceedings as against the defendant shall, unless otherwise ordered, be deemed to have begun only on such service being effected. (2) Such service shall, unless otherwise ordered by the court or a judge, be effected in the same manner in which original defendants are served. ˙ Actions by and against infants 26. An infant may sue or carry on the proceedings in any action or matter by the infant’s next friend, and may appear in any action or matter by the infant’s guardian ad litem . ˙ Patients within the meaning of the Mental Health Act 1974 27. A person declared to be a patient (within the meaning of the MentalHealth Act 1974 ) may sue or defend or intervene in any action or matter by the committee of the patient’s person or estate, as the case may be. ˙ Patients (within the meaning of the Mental Health Act 1974) without committees 28. A person who is a patient (within the meaning of the Mental HealthAct 1974 ) but has not been so declared, and a person so declared, but of whom a committee of the patient’s person or estate, as the case may be, has not been appointed, may sue by the patient’s next friend, and may defend or intervene by a guardian appointed by a judge for that purpose.
r 29 24 r 32 District Court Rules 1968 ˙ Next friend 29.(1) Before the name of any person is used in any action or matter as next friend of any infant or other party, such person shall sign a written authority to the solicitor for that purpose, and the authority shall be filed in the registry with the originating proceeding. (2) The authority shall not extend to any other proceeding than that specified in it. (3) A corporation other than the public trustee can not be a next friend or a guardian for the purpose of bringing or defending an action. ˙ Adoption of actions commenced without next friend 30.(1) If any action or matter is commenced without a next friend by an infant or by a patient (within the meaning of the Mental Health Act 1974 ) who has not been so declared or by a patient (within the meaning of the Mental Health Act 1974 ) so declared, but of whose person or estate, as the case may be, a committee has not been appointed, any person may by written authority to the solicitor for that purpose, which authority shall be filed in the registry, adopt the proceedings on behalf of the plaintiff and agree to be appointed as next friend of the plaintiff in the action or matter. (2) Thereupon the name of such next friend shall be added to the title of the action or matter and all previous proceedings in the action or matter shall be as valid and effective for all purposes as though they had been instituted in his or her name as next friend of the plaintiff. ˙ Removal and appointment of next friend and guardian ad litem 31.(1) The court or a judge may, for sufficient cause shown, remove a next friend or guardian ad litem . (2) Whenever for any reason there is no next friend or guardian ad litem of an infant, the court or a judge may appoint a fit person, with the person’s own consent, to be such next friend or guardian. ˙ Consent of persons under disability to procedure 32. In any action or matter to which any infant or patient (within the
r 33 25 r 36 District Court Rules 1968 meaning of the Mental Health Act 1974 ), whether so declared or not, or a person under any other disability, is a party, any consent as to the mode of taking evidence or as to any other procedure shall, if given with the sanction of the court or judge by the next friend, guardian, committee, or other person acting on behalf of the person under disability, have the same force and effect as if such party were under no disability and had given such consent. PART 4—JOINDER OF CAUSES OF ACTION ˙ All causes of action may be joined 33. Subject to rules 34 to 40, a plaintiff may unite in the same action several causes of action. ˙ Claims by trustee in bankruptcy 34. Claims by a trustee in bankruptcy as such shall not, unless by leave of the court or a judge, be joined with any claim by the trustee in any other capacity. ˙ Husband and wife 35. Claims by or against husband and wife may be joined with claims by or against either of them separately. ˙ Executors and administrators 36. Claims by or against an executor or administrator as such may be joined with claims by or against the executor or administrator personally— (a) if the lastmentioned claims are alleged to arise with reference to the estate in respect of which the plaintiff or defendant sues or is sued as executor or administrator; or (b) with the leave of the court or a judge.

Claims by plaintiffs jointly may be joined with claims by them or any of them separately against the same defendant. ˙ Claims for wrongs against several defendants 38.(1) Claims for damages against several defendants for wrongs alleged to have been committed by them severally shall not be joined in the same action, nor shall a claim for damages against several defendants for a wrong alleged to have been committed by them jointly be joined with a claim for damages for a wrong alleged to have been committed by some or 1 of them only. (2) But this rule shall not prevent judgment from being given against any 1 or more of several defendants alleged to have jointly committed a wrong. ˙ Remedy for misjoinder 39. When the plaintiff has united in the same action several causes of action, any defendant who alleges that they can not all be conveniently disposed of together may at any time apply to the court or a judge for an order limiting the action to such of the causes of action as may be conveniently disposed of together. ˙ Order for exclusion 40. If, on the hearing of an application under rule 39, it appears to the court or judge that the causes of action are such that they can not all be conveniently disposed of together, the court or judge may order any of such causes of action to be excluded, and may order any consequential amendments to be made, or may order separate trials of any of such causes of action to be had, or may make such other order as may be necessary or expedient for the separate disposal thereof, and may make such order as to costs as may be just.
r 43 27 r 45 District Court Rules 1968 PART 5—COMMENCEMENT OF ACTIONS Division 1—Plaints ˙ Action commenced by plaint 43.(1) Every action in a District Court shall be commenced by a plaint in writing in the form prescribed which shall state the names and last-known place of residence of the parties and the nature of the claim and shall contain a concise statement of the material facts on which the plaintiff intends to rely but not the evidence by which they are to be proved. (2) The plaintiff shall not be entitled to rely at the hearing on any facts not stated in the plaint unless the judge allows the plaintiff to amend his or her plaint and then only on such terms and conditions as the judge deems fit. (3) The plaint shall also have on its face a notice stating the time within which an entry of appearance and defence to the plaint must be filed and that if an entry of appearance and defence is not filed within that time judgment may be obtained by the plaintiff for the amount claimed and costs. ˙ Delivery of plaint to registry 44.(1) The plaintiff shall deliver to the registry not less than 2 copies of the plaint. (2) The registrar or an officer on the registrar’s behalf shall mark the copies with the date of presentment and mark on them the year of filing and the number for that year in accordance with the order in which they are presented for filing, and shall file 1 of the copies, shall sign and seal 1 of the copies or if requested more than 1 and shall return the signed and sealed copy or, as the case may be, copies to the plaintiff. ˙ Abandonment to appear on plaint 45. Where the plaintiff desires to abandon any part of the plaintiff’s claim, or to admit a counterclaim or set-off, and sues in a District Court for the residue, the abandonment, or the admission of the counterclaim or set-off, shall appear on the face of the plaint and all copies.
r 46 28 r 50 District Court Rules 1968 ˙ Service as prescribed 46. The plaint shall be served on the defendant in the manner prescribed by these rules. ˙ Misnomer or inaccurate description 47. A misnomer or inaccurate description of a person or place in a plaint shall not vitiate the same, if the person or place is described as commonly known. ˙ Form of plaint 48. The plaint shall be in the form in schedule 1. ˙ Plaint when equitable claim 49. In an action in which a plaintiff seeks to enforce an equitable claim under the provisions of the Act, the plaint or so much of it as relates to the equitable claim shall express that the plaintiff is suing upon equitable grounds. ˙ Counsel’s name to be added 49A. Where a plaint is settled by counsel the name of the counsel shall be written on the plaint. Division 2—Address for service ˙ Address for service 50. Every plaint, entry of appearance and defence and defence and counterclaim shall give an address for service of the plaintiff or the defendant as the case may be within the State in the following form— “The address for service of the [ plaintiff or as the case may be ] is at ”.

(2) Unless otherwise provided, any notice or service required by the Act and these rules may be made by posting the notice or document to be served, addressed to the person to be served or the person’s solicitor at such address for service. Division 3—Renewal of plaint ˙ Plaints to expire after 12 months 52. No plaint shall be in force without service for more than 12 months from the day of the date thereof, including the day of such date; but if any defendant therein named has not been served within that time, the plaintiff may, before the expiration of the 12 months, apply in writing to the registrar for leave to renew the plaint. ˙ Renewal of plaint where service not effected 53.(1) The registrar, if satisfied that reasonable efforts have been made to serve such defendant, and service has not been effected, or for other good reason, may order that the plaint be renewed for a further period not exceeding 12 months from the date of such renewal, inclusive of such date, and so on from time to time during the currency of the renewed plaint, and the plaintiff may apply for such renewal accordingly. (2) However, no plaint shall, without the leave of the court, be extended for periods exceeding in the aggregate 5 years from the date of the filing of the plaint. ˙ Requirements for renewal of plaint 54.(1) The plaint shall be renewed by being marked with the word ‘Renewed’ or ‘Renewed for (a period (stating it))’, and the date of such renewal, and such marking shall be sealed with the seal of the court by the proper officer.
r 55 30 r 55 District Court Rules 1968 (2) A plaint so renewed shall remain in force and be available to prevent the operation of any statute whereby the time for the commencement of any action is, or may be, limited, and for all other purposes, from the date of the filing of the original plaint. (3) Where a plaint is renewed or an application is made for the purpose of preventing the operation of any statute as aforesaid, it shall not be necessary that any attempt has been made to serve the plaint on the defendant and such purpose shall be a good reason for the court to order that the plaint be renewed. (4) Particulars of the renewal of the plaint shall be written in red ink in the plaint book. (5) The production of a plaint purporting to be marked so as to show that the same has been renewed in manner aforesaid, shall be sufficient evidence of its having been so renewed, and of the commencement of the action as of the original date of filing of the plaint, for all purposes. PART 6—SERVICE OF PROCESS ˙ Service of plaint 55.(1) A plaint or other process of the court shall, except when otherwise prescribed, be served upon the person to whom it is directed by delivering a copy to the person personally, or, if the person can not be found, by leaving it with some person for the first person at his or her place of residence or principal place of business or at the place given as his or her address for service. (2) If no person can be found at any such place, the plaint or other process may be served in such manner as a judge directs. (3) A plaint or other process shall be served on a corporation or company at the registered office (if any) of the corporation or company, and if there is not a registered office, then upon a member, officer or employee of the corporation or company, at the principal place of business of the corporation or company in Queensland (if any can be found) or in any other manner authorised by law, or in such manner as a judge directs.
r 56 31 r 59 District Court Rules 1968 (4) The person who serves a plaint or other process of the court shall, within 3 days after service, endorse on the relevant signed and sealed plaint or other process a statement of the day and place and manner of service and the person’s signature. ˙ Proof of service by bailiff 56.(1) When a plaint or other process of the court is served by a bailiff, the bailiff may attend before a justice and depose on oath to the time, place and manner of the service. (2) The relevant signed and sealed plaint or other process shall be exhibited to such deposition, and shall, on production to the court, be sufficient proof of the service. ˙ Undertaking to accept service 57. Any plaint or other originating process, shall be deemed to have been duly served upon a party if a solicitor accepts service thereof on behalf of such party and signs a memorandum to that effect. ˙ Personal service, how effected 58. Personal service shall be effected in the case of a plaint or other originating process authenticated by the seal of the Court by delivering to and leaving with or offering to deliver and leave with the person to be served a copy of the plaint or other originating process in such a condition as to be open for examination and at the same time offering to show the person a sealed copy of the plaint or other originating process and showing the person the same if the person requires it; and in the case of any other document, by delivering or offering to deliver the same to the person to be served in such a condition as to be open for examination. ˙ Service out of the jurisdiction 59.(1) A plaint or other process in relation to a proceeding that is within the jurisdiction of a District Court may be served on a person outside Australia and the external Territories, without the leave of a Court, if any of the following paragraphs apply—
r 59 32 r 59 District Court Rules 1968 (a) the proceeding is founded on a cause of action arising in Queensland; (b) the subject matter of the proceeding is— (i) property situated in Queensland; or (ii) the perpetuation of testimony relating to property in Queensland; (c) any Act, deed, will, contract, obligation or liability affecting property situated in Queensland is sought to be construed, rectified, set aside or enforced in the proceeding; (d) the proceeding is for any relief against a person domiciled or ordinarily resident in Queensland; (e) the proceeding is for— (i) the administration of the estate of a person who died domiciled in Queensland; or (ii) any relief that might be obtained in a proceeding for the administration of the estate of a person who died domiciled in Queensland; (f) the proceeding is for the execution of a trust and— (i) the trust is created or declared by an instrument; and (ii) the person is a trustee; and (iii) the execution relates to trust property situated in Queensland; and (iv) the trust ought to be executed according to the law of Queensland; (g) the proceeding is to enforce, rescind, dissolve, rectify, annul or otherwise affect, or to recover damages or other relief in relation to the breach of, a contract that— (i) was made in Queensland; or (ii) was made by 1 or more parties carrying on business or residing in Queensland; or (iii) was made by or through an agent carrying on business or residing in Queensland on behalf of a principal carrying on
r 59 33 r 59 District Court Rules 1968 business or residing outside Queensland; or (iv) is governed by the law of Queensland; (h) the proceeding is founded on a breach of contract committed in Queensland, regardless of where the contract was made and whether or not the breach was preceded or accompanied by a breach (wherever occurring) that renders impossible the performance of a part of the contract that ought to be performed in Queensland; (i) the proceeding is founded on a contract that contains a term by which the parties agree to submit to the jurisdiction of District Courts; (j) the proceeding is for the recovery of an amount payable under an Act to a person or body in Queensland; (k) the proceeding is founded on a tort committed in Queensland; (l) the proceeding is for damage that— (i) was suffered in whole or part in Queensland; and (ii) was caused by a tortious act or omission (wherever happening); (m) the proceeding is for a contribution or indemnity for a liability enforceable in a Court; (n) the proceeding is for an injunction ordering the defendant to do, or refrain from doing, anything in Queensland (whether or not damages are also claimed); (o) the proceeding is properly brought in Queensland against a person and another person outside Queensland is a necessary or proper party to the proceeding; (p) the proceeding is brought under the Civil Aviation (Carriers’ Liability) Act 1959 (Cwlth)— (i) by a resident of Queensland; or (ii) in relation to damage that happened in Queensland; (q) the person has submitted to the jurisdiction of District Courts; (r) the subject matter of the proceeding, so far as it concerns the
r 60 34 r 60 District Court Rules 1968 person, is property in Queensland; (s) the proceeding concerns the construction, effect or enforcement of— (i) an Act; or (ii) an Imperial or Commonwealth Act that affects property in Queensland; (t) the proceeding is for the custody, maintenance or advancement of an infant who is domiciled or present in, or a resident of, Queensland; (u) the proceeding, so far as it concerns the person, falls partly within 1 or more of paragraphs (a) to (t). (2) Each paragraph of subrule (1) is to be construed independently of the other paragraphs and the construction of a paragraph is not to be taken to affect the construction of another paragraph. (3) Any other process, notice or order, issued, given or made in a proceeding may be served outside Queensland with the leave of a Court or a judge. ˙ Personal service not required 60.(1) This part shall apply in relation to the service of a plaint or other originating process notwithstanding that it is to be served out of the State. (2) Nothing in this part, or in any order or direction of the Court or a judge made by virtue of this part, shall authorise or require the doing of anything in a country in which service is to be effected which is contrary to the law of that country. (3) A plaint or other originating process which is served out of the State need not be served personally on the person required to be served so long as it is served on the person in accordance with the law of the country in which service is effected. (4) Subrules (1) to (3) shall apply in relation to any document for the service of which out of the State, leave has been granted under rule 59(3).
r 61 35 r 64 District Court Rules 1968 ˙ Court may make directions when defendant fails to appear 61. The court or a judge upon being satisfied by affidavit that the action or matter is such that, under rule 59 the plaint or other process may be served out of the State, and that it was served upon a party out of the State, either personally, or in accordance with an order made under rule 75, or in accordance with the law of the country in which service was effected, or that reasonable efforts were made to effect service in any such manner upon the party to be served and that it came to the party’s notice, and either that the party wilfully neglects to appear in the action or matter, or that the party is living out of the State in order to defeat or delay the plaintiff, may direct from time to time that the plaintiff shall be at liberty to proceed in the action or matter in such manner and subject to such conditions as to the court or judge may seem fit. ˙ Affidavit in support 62.(1) An application for a grant of leave under rule 59(1)(e) or (3) must be supported by an affidavit stating the grounds on which the application is made and showing in what place or country the person to be served is or probably may be found. (2) No such leave shall be granted unless it shall be made sufficiently to appear to the court or a judge that the case is a proper one for service out of the State under this part. ˙ Husband and wife 63. When husband and wife are both parties to an action or matter, they shall both be served unless the court or a judge otherwise orders. ˙ Infants 64.(1) When an infant is a party to an action or matter, service on the infant’s father, mother, or guardian, or if the infant has none, then upon the person with whom the infant resides, or under whose care the infant is, shall, unless the court or a judge otherwise orders, be deemed good service on the infant. (2) However, the court or a judge may, on application, order that service
r 65 36 r 68 District Court Rules 1968 made or to be made on the infant himself or herself shall be deemed good service. ˙ Patients within the meaning of the Mental Health Act 1974 65. When a patient (within the meaning of the Mental Health Act 1974 ) is a party to an action or matter, service on the committee (if any) of the patient’s person or estate, as the case may be, or, if the patient has not been declared to be a patient, or if the patient has so been declared but a committee of the patient’s person or estate, as the case may be, has not been appointed, service on the person with whom the patient resides or under whose care the patient is, shall, unless the court or a judge otherwise orders, be deemed good service on such party. ˙ Prisoners 66. When a defendant is employed and dwells, or is imprisoned in any prison, gaol, or other place of confinement, service at that place upon the governor or superintendent or any person appearing to be at the time the officer in charge thereof or, if service upon that person can not be effected, then upon the gatekeeper or lodge-keeper of that place of confinement shall, unless the court or a judge otherwise orders, be deemed good service on such defendant. ˙ Mariners 67. When a defendant is living or serving on board any ship or vessel, service upon a person on board who is or appears to be at the time, in charge of the ship or vessel shall, unless the court or a judge otherwise orders, be deemed good service on such defendant. ˙ Soldiers etc. 68. When a defendant is serving as a member of any naval, military, or air force and is residing or quartered in any barracks, camp, or other place, service at that place upon the adjutant or any officer or sergeant (or person holding a rank corresponding to or higher than sergeant) of the unit to
r 69 37 r 71 District Court Rules 1968 which the defendant belongs, shall, unless the court or a judge otherwise orders, be deemed good service on such defendant. ˙ On agent—service on agent 69.(1) When a contract has been entered into within the State by or through an agent residing or carrying on business within the State, on behalf of a principal residing or carrying on business outside the State, a plaint in an action relating to or arising out of such contract may, by leave of the court or a judge given before the determination of such agent’s authority, or of the agent’s business relations with the principal, be served on such agent. (2) A copy of the order giving such leave, and of the plaint shall forthwith be sent by post to the defendant at the defendant’s last-known place of residence or of business out of the State. (3) Nothing in this rule shall invalidate or affect any other mode of service authorised by these rules or by the laws of the Commonwealth or of a Territory or of any State outside Queensland. ˙ Service by local government in certain cases 70. In any action commenced by a local government, within the meaning of the Local Government Act 1993 , and brought under or for any of the purposes of that Act in a Court, service of any plaint or other process of the court may be effected on the defendant by registered post at the defendant’s usual or last-known place of residence or business, or the address in Queensland for service last notified for the purpose by the defendant to the local government by separate written advice, or the registered office under or for the purposes of any Act which requires the defendant or any firm of which the defendant is a member to have a registered office. ˙ Service by registered post 71.(1) Service on any person pursuant to these rules or an order of the court or judge by registered post shall be effected by forwarding a sealed copy or copies of the plaint, documents, or other process by prepaid registered post as provided by the postal regulations for the time being in force, in a letter or packet addressed to such person at such place or address as by these rules such service may be effected and such service shall, unless
