District Court Amendment Rules 2024

Made by the judges of the District Court.

1.Citation

These rules are the District Court Amendment Rules 2024.

2.Commencement

These rules come into operation as follows —

• (a)

  rules 1 and 2 — on the day on which these rules are published on the WA legislation website;

• (b)

  the rest of the rules — on 1 July 2024.

3.Rules amended

These rules amend the District Court Rules 2005.

4.Rule 49 amended

In rule 49 in the definition of WCIMA appeal delete “Workers’ Compensation and Injury Management Act 1981 section 247(1).” and insert:

Workers Compensation and Injury Management Act 2023 section 391(1).

5.Rule 51 amended

In rule 51(4A)(b) delete “Workers’ Compensation and Injury Management Act 1981 section 247(1),” and insert:

Workers Compensation and Injury Management Act 2023 section 391(1),

Note: The heading to amended rule 51 is to read:

Commencement of appeals

6.Rule 55 amended

• (1)

  In rule 55(2) delete “Workers’ Compensation and Injury Management Act 1981 section 247(1).” and insert:

   

Workers Compensation and Injury Management Act 2023 section 391(1).

• (2)

  In rule 55(3)(aa) delete “Workers’ Compensation and Injury Management Act 1981 section 247(6) or making an order under section 250(1)” and insert:

   

Workers Compensation and Injury Management Act 2023 section 391(6) or making an order under section 392(1)

7.Rule 57 amended

In rule 57(3):

• (a)

  in paragraph (a) delete “Workers’ Compensation and Injury Management Act 1981 section 247(1); or” and insert:

   

Workers Compensation and Injury Management Act 2023 section 391(1); or

 

• (b)

  in paragraph (b) delete “247(6) or make an order under section 250(1)” and insert:

   

391(6) or make an order under section 392(1)

  8.Schedule 1 amended

In Schedule 1 Form 8A:

• (a)

  delete “Workers’” and insert:

   

Workers

 

• (b)

  delete “Workers’ Compensation and Injury Management Act 1981 (WCIMA) section 247.” and insert:

   

Workers Compensation and Injury Management Act 2023 (WCIMA) section 391.

 

• (c)

  delete “247” and insert:

• (d)

  in note 4 delete “247.” and insert:

• (e)

  in note 8 delete “247(6) or a stay under section 250(1).” and insert:

   

391(6) or a stay under section 392(1).
